2 Ethics Violation Analysis The board of ethics is put into place to make sure social workers follow the rules and obligations to our clients. If a social worker deviates or violates the rules or principles the board is notified, and an investigation is put under way to make sure there was a violation and the seriousness of that violation. Then they are required to find an appropriate discipline action. When it is acknowledged that a social worker has violated their professional obligations, they need to be reported. The first place to start would be your supervisor. This can be done by verbally speaking to them or if you need confirmation, it can be sent in a secured private e-mail. From there your supervisor can take it to the board of ethics. If you feel that your supervisor has not reported the situation you can take it upon yourself to contact the board of ethics as well. Some violations could include but are not limited to failure to report violations of coworkers. This could be them drinking on the job or it is affecting their judgment in treatment of the client. Another one is the release of any information about your clients without having a authorization to do so from the client. This would include the name of the person that the release of information is given to the dates of information that are okay to
3 be shared with that person. And a signature from the client or the client’s guardian. If you do not have these Ethics Violation Analysis things in place, it would be a violation of their HIPAA rights. Having inappropriate relationships with clients, such as a dual relationship where you are not only client and professional but outside of the treatment facility you also our friends. This would be a conflict of interest and the client needs to be referred to someone else and you need to recuse yourself from their treatment. Also falsifying documents in charting as well as the omission of pertinent information when charting. 30 days from the date of the complaint reaching the board of ethics, it is signed a complaint number in an investigation to make sure that the person involved in the complaint is an employed and licensed social worker. They will also investigate if the person falls under any other therapist license That could be under the boards review. They must also determine that it falls in their jurisdiction. Each state has its own board of ethics committee. After that is established then it is assigned to a person on the board that is qualified to analyze the complaint and violation. A notification is sent for verification of the receipt of the complaint. From here it is then reviewed and the proper disciplinary act. The supervisor is notified as well as the person that had the complaint filed on.

4 Ethics Violation Analysis I agree with anybody that violates the code of ethics should be reviewed inappropriate disciplinary action should be expected. We as social workers are bound by fundamental requirements that focus on social injustice for the impoverished and people that have been oppressed. With these requirements we are to give every person all available resources that we have, regardless of their differences. As a social worker we need to be able to analyze any environmental factors that are causing the injustice, so we can do our due diligence to correct what needs to be corrected (NASW,2021). An employer should only employ individuals that have the appropriate credentials and knowledge to perform their duties in a professional manor. Social workers are to do no harm, in putting someone in the position that they are not qualified for would harm the client and then the employee would also be reprimanded by the board. As soon as the social worker has finished with the client they should be documenting in the medical records about the session. That way everything is fresh in their mind and no mistakes will be made. This can be done either through written charts or secured software. Is of the utmost importance that social workers keep abreast on any changes that have been made in your resources and the community as well as educational. The continuing education can be done by reading updated articles by attending conferences or from other
5 peers. Depending on the state continuing education maybe mandatory and have designated hours per year to keep your license. Ethics Violation Analysis It is important that everybody works together and communicates with each other. Being professional does not mean just being professional in front of your clients, it means being professional to everyone. With everyone paying attention to possible violations it will lessen the probability and keep the clinic running well. If there are too many violations or the owner of the clinic is cited for violations the facility may very well be fined or even be closed.
