Intellectual Testing: The Competence Assessment for Standing Trial for Defendants with Mental Retardation (CAST-MR) Test of Memory Malingering (TOMM) administered in conjunction with Competency Assessment Instrument (CAI). DIAGNOSIS OF EFENDANT’S MENTAL CONDITION: a) Diagnostic Analysis: b) Diagnosis: UNDERSTANDING OF THE LEGAL SITUATION: EXAMINER’S ASSESSMENT AND OPINION REGARDING COMPETENCE TO PROCEED: 1. Factual Basis for Determining if Legal Standard for Competency is met (intellectual deficiency): Assessment choices: 1. The Competency Assessment Instrument (CAI) consists of a semi-structured interview that provides the basis for 5-point Likert ratings and provide an organized format for guiding the interview. The Test of Memory Malingering (TOMM) assesses examinee’s response styles and effort during assessments of cognitive functioning. TOMM paired in conjunction with the CAI is a method used to detect feigning of intellectual impairment. 2. The Competence Assessment for Standing Trial for Defendants with Mental Retardation (CAST-MR) was designed with the sole purpose of evaluating those with intellectual functioning that is impaired. The general interview assessments yield inaccurate results; therefore assessment tools that have multiple-choice (for example), and appropriately and specifically applied vocabulary and content take the pressure off of the defendant’s answers being independent focused.
