Running head: [SHORTENED TITLE UP TO 50 CHARACTERS] 1 3-3 Short Paper: The History of Child Custody Arrangements Hailey Hanson • A brief overview of how child custody arrangements have evolved over the years • A discussion of the cultural changes that have affected the evolution of child custody in the United States, making sure to explain how specific societal changes influenced legal custodial arrangements • A summary of the current trends in child custody arrangements in the United States Child custody arrangements have dramatically changed throughout our history and will most likely continue to change as new circumstances emerge. Such as same sex marriage, this was a factor to consider in the Miller-Jenkins vs Miller-Jenkins case in 2006 (Costanzo & Krauss 2020). Janet did not consider the factor that her ex-wife would renounce her homosexuality and withhold visitation rights from the daughter they shared and this caused issue because they were in different states and the laws varied at the time on domestic partnerships and custody arrangements within each state (Costanzo & Krauss 2020). This case shows how and why the laws and arrangements change throughout the years because there are varies types of laws in different states about. Cultural changes that have affected the evolution of child custody in the

Increased divorce rates in the US has impacted the laws created because there was an influx of different circumstances that were flowing in throughout the years that needed to be addressed. Divorce is not always just signing some parents and seeing the kids on the weekend. When a couple has children and they decide to get a divorce and it turns into an “ugly” divorce it could take years for them to bat tle it out in our court system. Lawmakers and citizens will hopefully continue strive to change laws to make it an easier process for everyone involved. According to the book the legal system and the psychology system will try to vaguely to what’s in the c hild’s best interest through mostly sole custody arguments and/or visitation (Costanzo & Krauss 2020). The legal system and the psychologist should start to work closer together to figure out better solutions for the child’s best interest.
