Teachers and administrators are expected to maintain discipline in the schools. By and large, the
courts have been supportive of reasonable rules that are enforced equally with no discriminatory purpose or effect. Some states and districts allow for the use of corporal punishment in schools.
a.
What does your state’s statute permit? If the state permits it, did your district/school allow it?
The 1977 Supreme Court ruling of Ingraham v. Wright found that corporal punishment was constitutionally allowed. As of 2008, there are 21 states that are allowed to use corporal punishment. One of those states include Missouri. Even though there were states allowed to use such punishment, a lot of schools still banned this way of student punishment. Other schools have issued guidelines regarding corporal punishment. Chapter 160.261 of Missouri Statutes, it states that each school district will determine on the use of corporal punishment. I grew up in Missouri and attended Cape Public Schools. I never heard of anyone getting corporal punishment my entire time there from kindergarten all the way to 12
th
grade. Also in their policies on the website it states that corporal punishment is NOT allowed.
b.
What are the risks for educational employees?
Some risks for educational employees that use corporal punishment could be the possibility of getting sued by the parents of the kid that receives the corporal punishment due to injury or other reasons. Students can also feel unsafe at school, cause physical and mental ill-health issues, and cause the opposite of a solution and instead causes worse or aggressive behavior. c.
Do you support the use of corporal punishment in schools? Why or why not?
I personally do not support the use of corporal punishment. I believe it will cause more problems than anything. Students can feel unsafe at school which is something you never want. Also, it can cause major court battles with parents and school district which also just causes more problems. I also
believe there are just so many other ways to punish or solve an issue with a student that isn’t violent.

Due Process Questions

Why is due process important for student rights?
Due process is important for student’s right the 5

Amendments state that it is a constitutional right. Property interest is also affected when a
student is prevented access to a public-school education. If you suspend a kid without proper evidence or reasoning on length of time, you are doing bad of the student. Due process is important to hear all sides and get all the information possible before making a decision involving the student and their education, good name, integrity, or reputation as this can have long lasting effects. b.
What is substantive due process?
Substantive due process is kind of like a check to make sure that everything is fair and valid concerning the student and the decision of the school. Whether that be making sure that the student was adequately notified along with it having valid and appropriate evidence for the opposed bad behavior or “crime” to cause the student to be punished. (There are four question to determine so)

What is procedural due process?
The procedural due process is more specifically the notice and the right to a fair hearing. Making sure that the minimum number of steps is taken by the school to reach the decision is also a component of procedural process. 3.
Student Handbooks and/or Student Discipline Codes serve to apprise students, parents, and faculty of the expectations for student conduct in schools. List 10 items or issues that should be included in a Student Handbook or Student Discipline Code and explain why each item is important to support the educational process.
1. All levels of discipline should be talked about with a student handbook. It is important to have this section within the handbook, so all parties are aware of the details if one is to be disciplined to each degree. This way there will be no argument from parents or students since the various punishments of
each level of discipline will be listed out. This should help the educational processes by preventing and
punishing students to keep try and help keep a healthy learning environment. 2. I also believe bullying and cyberbullying should be mentioned within the student handbook. It is important make aware that there is a zero tolerance of such behavior or support the educational environment of all students.
3. Student dress code should also be mentioned within the student handbook. This helps to make sure
that everyone knows the school’s policies on what you can and cannot wear. This promotes the educational process by not having to have students leave class due to a violation of dress code.
4. A district academic calendar is something that should be located on a student handbook. This allows for parents and students to know what days the school might not be in session due to various stated reasons. This supports the educational process by making sure students know which days to be at school ready to learn. 5. A list and description of every extracurricular activity should be listed in the student handbook. This
is an easy place to see all the different opportunities a student can participate at school in. This also supports the educational process by having students involved with the school. With students being involved with the school after hours, this usually has a great positive impact with students in the classroom. 6. Attendance and absenteeism should be added in the student handbook. By clearly stating what rules and punishments for arriving late or not at all will be necessary if a student/parent challenge the
reasoning or severity of the punishment received for such action. This promotes students to be on time and present to school which promotes a very import lifelong lesson necessary in life.
7. Bus information should also be added in the student handbook. This is how a lot of kids get to school and is necessary information needed for those students. This information needs to be in an accessible and easy place to find for all. This information supports the educational process by allowing
student the access to get to school to learn.
8. Grading information should be added to the student handbook. This is important because it should clearly state the grading scale/key of which the students are assessed on. This is important to the educational process because it allows the students to see what percentage grade earns you what letter grade as it may vary from school to school.
9. Statement of Academic Honesty should be included in the student handbook. Here it clearly states that cheating, plagiarizing, or the use of electronic translators are not allowed. This supports the educational process by showing students that this is not okay or allowed in any fashion.
10. A school counseling section should be added to the student handbook that states what they can do and also how to find/contact them. This is important because students need to know that there are others to help them through tough decisions or even their emotional wellbeing. Some of these tough life decisions that the counselors can help is signing up for the ACT, career planning, academic advising and scheduling, vocational decision-making and post-secondary planning. This is necessary for educational process because it helps students get to the people they need that can help with a variety of needs.
