LESSON 4 DISCUSSION 2 Lesson 4 Discussion 1. How do you intend to conduct the interview? I will conduct the interview with objectivity to remain as neutral as possible to gather adequate information that can help the court to reach an appropriate judgment. The offender needs to find the comfort to describe the circumstances that surround the offense that they committed for me to get many details ( Abadinsky, 2017). His personal and criminal records are also critical things that the court needs to know and only some form of friendly interviewing will facilitate the process ( Abadinsky, 2017). I would also love to know if the offender was undergoing some rehabilitation in programs such counseling and addiction treatment. I will ask the defendant all the questions that demonstrate the good side of them so that the verdict takes into account of all the information. 2. What topics would you discuss that you think would give the judge a fair understanding of the offender? I would ensure that the offender explains to me on any rehabilitative programs that they were undergoing at the time of the crime happening. I would also love to know if the offender was in some counseling before the incidence as well as any addiction treatment program ( Abadinsky, 2017). Knowing the offender’s history since childhood and the criminal record are also important questions that will help the court in understanding the offender better (Carr & Maguire, 2017). The offender will also reveal if they suffer from any
LESSON 4 DISCUSSION 3 psychological disorder or condition that has been the stressor or trigger behind their criminal behavior. 3. What would your final recommendation to the judge be based upon? I will base my final recommendation to the judge by basing on various primary factors. The mental state of the offender will be of important concern. If the offender suffers from a mental illness, then their criminal behavior could be originating from this. If the offender has a problem such as the bipolar disorder, it is likely that the condition is the onset of the problems (DeMichele & Payne, 2018). On the other hand, criminal records of the offender are critical after confirmation that they lack mental illnesses or disorders. Their personal life history is also important because it helps the court in understanding the environment that mainly influenced their criminal behaviors ( Abadinsky, 2017).
