CASE STUDY 2 Marriage is taking a downward trend with each passing year. It seems less and less men want to marry their partners. The news is spreading like wildfire over the internet of how unjust the divorce and family court system is for men. The support groups for father’s rights are growing within Facebook and are helping to spread the word of the difficulties we face. Although marriages are happening every day, divorce and family courts are to blame for the decline in marriages given the risk and cost for a man. Marriage The definition of marriage has been broadened to encompass the different types of marriages that are currently recognized by systems of law, cultures, and religions. Merriam- Webster defines marriage as the state of being united as spouses in a consensual and contractual relationship recognized by law. Merriam-Webster. (n.d.). However, we will focus more on a marriage between a man and a woman for simplicity. According to the Centers for Disease Control and Prevention, the marriage rate in the United States for 2021 is 6 out of 1000 total population. Centers for Disease Control and Prevention. (2023, February 23). While men are still proposing and marrying the so-called love of their life, they are not prepared for the journey they will embark upon when things go south. Before I married my first wife, I spoke with my uncle who was the closest male father figure I had in my life. He was the only married male role model in my life. We discussed it and I felt ready for the next step in my life. Before we married, she was pregnant with my first-born son and I felt it was the right thing to do. Like most men, I wanted to do what was right and I married her. We loved each other and we wanted to give our son a proper family to be raised by. 2
CASE STUDY 2 Divorce Merriam-Webster defines divorce as the act or instance of legally dissolving a marriage. Merriam-Webster. (n.d.). According to divorce statistics in 2022 from Couples Academy, divorce rates are 16.9 for every 1000 married women. They also report that in 2022 approximately 50 percent of all marriages will end in divorce. Divorce statistics. Couples Academy. (2022, November 1). These numbers are alarming and from a statistics standpoint, you have an extremely high chance of your marriage ending in divorce. Divorce is also a costly process for most men given that they are the bread winners and do not qualify for indigent representation unlike many women. On average within the United States, a divorce will cost $12, 900 when contested and $7,500 when uncontested. Divorce statistics. Couples Academy. (2022, November 1). Due to my active-duty military service, I was very lucky to find an attorney that only charged me $2,500 for my divorce. Given the averages, most men are not as fortunate as I was with my divorce. When children are involved, divorce cost for a man increases as he will then be ordered to pay child support. According to the 2017 United States Census, the national average child support paid per year was $3,431 and 4 out of 5 mothers were the custodial parent. Wise, J. (2023, February 2). In my custody and child support matters, I was not as fortunate. My ex-wife is the primary custodial parent and I pay her $875 a month in child support. The highest amount that I paid before my son entered public school was $1070 a month. Father’s Rights and Support Group It is clear there is an unfair court system that fathers around the country must navigate. Unfortunately, it was only made aware to me when I went through my divorce and custody trial. It is extremely difficult to navigate the court system and its stressors on your own. Those difficulties are compounded by your responsibilities at your place of employment, the amount of 3

CASE STUDY 2 jobs you may be juggling to make ends meet, the distance you must drive to see your child or children, the cost of the transportation to and from, the cost of the activities planned with your child or children, and the cost of maintaining your child or children within your home. All these factors will cause high stress levels and wear down anyone given enough time. These were all factors that I struggled with and would cause me constant high levels of stress and anxiety. To help me deal with the high stress and anxiety I sought the help of a therapist and support groups for fathers via Facebook. I joined many support groups for fathers with tens of the thousands of members. These support groups opened my eyes to the struggles that other fathers were facing and helped me realize that I was not alone. Many of these men tell their stories and it’s just heartbreaking what we go through. Many of these men are taking to social media to spread awareness of the hardships men go through within the court system. Movements to better Father’s rights are being created in many states where Fathers need it most. While many of these movements fight for equal parenting time and custodial rights for fathers, they also fight to spread awareness of the injustices. The Father’s Rights Movement offers statistics for men to educate themselves and their sons. They polled men and women since 2021, however, 97 percent of the surveyors were men. Only 15 percent were awarded 50/50 custody, 80 percent of men reported not getting their custodial time from their coparent, 62 percent of men were denied their parenteral rights due to false allegations, 99 percent of men reported their coparent not being held accountable for perjury or false allegations by the courts, 46 percent of men were Pro Se litigants, 52 percent of men reported their state or county made it difficult to represent themselves, and 32 percent reported that their state or county nearly made it impossible. CASE STUDY 2 of statistics more men need to hear so they can make the best educated decision for themselves in regards to marriage. Unfortunately given the numbers, it does not end well for us. Conclusion While there are men who are stilling willing to marry their partners, more men are becoming aware of the risks and cost they must bear when the marriage falls apart. The divorce and family courts systems are heavily and unjustly tilted in a woman’s favor. Whether a man chooses to be a Pro Se litigant or hire representation, the end results statistically will be the same regardless of the court room. Our divorce and family courts need to be more cognizant of the disparities in their rulings and their ramifications. The more fathers that band together to take a stand, the more change we can create so that divorce in our country isn’t so incentivized for women. Until then we will continue to see marriage rates fall as more men are educated on the cost and risk. 5
