Elizabeth Teasley March 26, 2023 POLS 6230 Local Govt Admin Finance Instructor: Dr. Bryan LaBrecque Local governments in America have two types of governing authority: the Home Rule and the Dillion Rule. Both forms of governing authority were created so states can conduct legislation at a local level. It makes it possible for local and state governments to provide public safety, and infrastructure and communicate zoning issues. It also keeps local governments focused on what’s best for their states. So, states use either Dillion Rule or Home Rule to maintain a limited local government promoting economic continuously throughout its borders. The Dillion Rule originated in Iowa Supreme Court by Justice Joh Dillion, a member from 1869-1879. The Dillion Rule was created so that local governments can only legislate what the state government has decreed, Dillion Rule also grants state governments power to lead when local governments become irresponsible or uncooperative. Also due to Dillion Rule, helps protect local governments from implementing policies that can damage neighboring local jurisdictions. Dillion Rule is used for statewide stability and prosperity, The Home Rule Charter was created due to Judge Thomas Cooley challenging the Dillion Rule in 1871. The Home Rule Charters allows local governments to carefully pass ordinances as they see fit as long as they abide by the State laws and Constitutions. Missouri was the first state to pass a Home Rule Chapter in 1875, approximately 44 states have adopted the Home Rule Chapter in some

capacity. Local communities under the Home Rule Chapter can make use of some authority with local freedom without state interference. Some states also use both Home Rule and Dillion Rule, Dillion Rule is used in matters when governmental units are not accounted for in the constitutional amendment or statutes which then grants Home Rule. I believe local governments are creatures of the state because local governments exercise only powers they specifically granted to them for example many regulations that affect people’s daily lives such as schools, housing, and vital services for people and businesses are the responsibility of local government and they are given political power on how to serve people and businesses as they see fit.
