( Vote Wars ) Bush v Gore November 7, 2000 George W. Bush ( govern ) and Al Gore ( vice president ) What Happened november 8th - The vote for all states had been determined besides florida, without florida’s 25 electoral votes neither candidates could attain the 270 electoral needed to secure presidency - Preliminary tally in florida had bush ahead of gore by 1784 votes, the difference was less than one half of one percent of the total number of votes casted under fl election law this triggered an automatic electrical recount ( problems arose because at the time the florida voter was to use an stylist to vote ) the counting machines would reflexively reject is not include in any ballots they couldn't read ) After the recount it gave bush a still lead head in the election but by a noticeable lesser margin than in the intentional count, so gore decide to use the florida election law to do a manual recount, county by county which he did in four ( Volusia, Palm Beach, Boward, and Miami-Dade) There wasn't a standard in place for determining how the undervotes and overvotes should be counted. November 26, 2000 Bush was the winner of Florida, However Florida election law provided that the loser could challenge the certification in court, but only if the loser could show sufficient likelihood that so many conforming votes were rejected or non conforming votes counted as to cast genuine doubt on the outcome. Gore challenge the results of the manual recount the trail court rejected gore’s challenge entirely ( failed to meet his burden of proof) the supreme court reversed this result in part holding he did satisfied his proof )
