1. Provide a two-to-three sentence overview of what your paper will be about. This should include both the problem/condition and the policy response. Senate Bill 8 (SB 8), which went into effect on September 1, 2021, has had a significant impact on Texas’ legal abortion status. SB 8 is one of the most severe abortion laws in the United States, outlawing abortions as early as six weeks into a pregnancy. This is usually before an individual is aware of it. Adding to this debate, SB 8 uses an unprecedented enforcement process, which allows individuals to sue anyone involved in the procedure, which complicates the legal challenges to the law. 2. Provide an understanding of the history of the problem/highlight at least two key historical events/dates/acts, etc. that you will highlight in your paper. Here it is appropriate to talk about the history of the problem/condition as well as the history of the policy response though in your paper you’ll build on each of those. In Roe V. Wade, the US Supreme Court in 1973, legalized abortion nationwide. The Court held 7- 2, that a woman’s constitutional right to privacy protected her decision to terminate h er pregnancy. However, the Court recognized the state’s interest in regulating abortion to protect the mother’s health and the potential life of the fetus. This ruling established the framework within which governments can control abortion in the later stages of pregnancy, but not in the first semester. Roe v. Wade has dominated conversations over reproductive rights for decades. In 2021, Texas passes SB 8, which disputed this precendent. SB 8 has drastically limited access to abortion by prohibiting the procedure as early as six weeks into the pregnancy, which essentially undermines the protections provided by Roe v. Wade. Texas had strict restrictions in 1925 that reflected the trends of the US. Abortion was essentially banned, except where it was deemed necessary. Texas made abortion illegal outside of specific circumstances, punishing both the individual seeking the abortion, and those conducting the procedure. 3. Clarify what problem your chosen policy responds to. My chosen policy of the Texas Senate Bill 8 (SB 8), addresses the issue of abortion regulation in the state. SB 8 aims to investigate what proponents view as ethical and moral concerns about abortion by imposing tight restrictions on the practice. SB 8 is a response to the ongoing discourse around reproductive rights and the role the government has in regulating abortion access. 4. Consider the different and conflicting social values that “show up” in the development of legislation and social programs. Are there any values that you believe are prominently displayed within the legislation you’re researching? Here, you may need
to read the preamble to the legislation, comments about it, etc. What can you find that helps orient you towards the values that shaped this policy response to a social problem? Conflicting social values are when does life start? Women have the right to autonomy vs fetal rights. T he NASW provides a framework of principles to guide social workers. Social workers adhere to the belief that clients have the right to self-determination, which includes the right to make their own choices about their health care. The legal framework is important for social workers to be able to give informed and supportive services. 5. Based on the reading and research you’ve done this far; has the policy you’re analyzing been effective? What information are you using to generate that answer? I believe the success of SB 9 is nuanced and open to intpretation, with different perspectives depending on one’s own beliefs and objectives about reproductive rights and access to abortion.
