IDEA Summary The Individuals with Disabilities Education Act (IDEA) is a federal law in the United States that assures individuals with disabilities have access to free, appropriate public education (FAPE) that is tailored to the unique needs of each individual. This law was enacted in 1975 and reauthorized in 2004. IDEA emphasizes the provision of special education and related services to students from the ages of birth to 21. Professional practice standards play a crucial role in helping guide special education teachers in upholding the key components of IDEA. These standards guide educators in ensuring that students with disabilities receive FAPE, undergo appropriate evaluations, experience the least restrictive environment (LRE), and benefit from procedural safeguards. Free Appropriate Education (FAPE) is a professional practice standard that emphasizes the teacher's responsibility to provide an education that is tailored to the students needs. Special Education teachers must adhere to individualized instruction strategies, accommodations, and modifications. Teachers must ensure that the student receives an education that is both appropriate and meaningful. With FAPE, the student’s education comes free of charge to the parents/guardians. The public school system is responsible for all costs that will come with educating the student. Special education teachers conduct a thorough and comprehensive assessment of each student to be able to identify the student’s strengths and challenges accurately. In this assessment the teacher
will use different tools and techniques to inform individualized educational programs (IEP) and instructional planning. The Least Restrictive Environment (LRE) principle encourages the inclusion of students with disabilities in general education classrooms to the greatest extent that is possible. This is done by using the practice of the special education teacher providing inclusive environments, collaborating with the general education teachers, and by helping facilitate peer interactions to help ensure that the student with disabilities has the same access to the same learning experience as their peers and classmates. Special Education teachers will uphold procedural safeguards for all students with disabilities and their families. Procedural safeguards include parental involvement, maintaining confidentiality, and facilitating due process procedures in case of disputes. Parents are also able to inspect/review their child’s education records. Professional practice standards serve as a compass for special education teachers, helping align their practices with IDEA. By all special education teachers sticking to these standards, it will help play a very important role in fostering an inclusive educational environment that promotes academic and social success for students with disabilities. IEP Team Member Collaboration Collaborating among the members of the Individualized Education Program (IEP) is very important for ensuring the success of students with disabilities. The IEP meeting is normally composed of parents/guardians, the child's special education teacher, general education teacher, school administration, school psychologist, and related student service providers such as speech, physical therapy or other services the student is getting. In some cases the student with the IEP is on the team. If the student is on the team it will depend on the age and the level of involvement that the student will have in the decision process.
