Discussion #2 Select one benefit and compliance issue identified in Module 3 and share why you feel it is a potentially risky one of which all organizations need to be aware. Use a minimum of one reference from the class materials. No need to respond to other students. Module 3 reviews compliance issues related to benefits. The importance of compliance is reflected in the numerous laws established by the government to ensure fair treatment of employees. The laws apply to both government-mandated and discretionary benefits (opted into by the employer). One issue that can be potentially risky for employers is not following the Affordable Care Act. The Affordable Care Act of 2010 was passed by Congress and then signed into law by the President on March 23, 2010. On June 28, 2012, the Supreme Court rendered a final decision to uphold the health care law (UMGC). This topic was heavily debated when it was first proposed, and in many ways, it is still a 'hot topic.' The Affordable Care Act requires employers to offer health insurance to their employees or face fines from the federal government. Health insurance has always been a significant component of benefits offered by employers to attract and maintain employees. The Act establishes what type of health care needs to be provided and to whom (employees) qualify. When this Act came into effect, some organizations needed to change what type of health care they offered and who it was offered to. In addition to The Affordable Care Act, numerous laws and regulations exist, and it is easy to see how compliance issues can manifest. It is essential for experts to be involved with selecting the types of benefits offered, and for them to stay relevant on amendments or updates.
