Prompt Student Response Amendment: Choose the Fourth, Sixth, or Eighth Amendment Amendment: Fourth Amendment Summary: In 100–150 words, summarize the amendment you chose. Be sure your summary includes all rights given to citizens in that particular amendment. Summary: The fourth Amendment protects the citizens against any unreasonable search and seizure. This amendment requires law enforcement to obtain a search warrant signed by a judge before searching anything. The law enforcement officers would need to prove that the search is reasonable and necessary. Given the fourth amendment protects citizens privacy in their own homes, cars, bodies, and properties. Citizens’ Rights: Identify a real-world example of where citizens’ rights under the Bill of Rights may not be guaranteed. (Clearly explain where citizens’ rights could conflict with the intention of criminal justice professionals to ensure safety.) Citizens’ Rights: An example would be entering into a government sanctioned building such as a court house. They usually have security set up where you have to walk through a metal detector and your bag is being examined by an x-ray machine to make sure there isn’t anything that could do harm enter into the building. By entering in the building, you are basically giving up your fourth amendment right knowing you’d have to go through this to enter the building for the sake of safety. Professionals: Identify three to five examples of Professionals: First example would be illegally searching a person’s car without first going through the proper channels of getting a warrant from a judge and finding evidence. Another example would be the Katz V. United States case where the FBI attached a listening device to a payphone that Katz was using to record his conversations transmitting gambling information in other states. They violated his 4 th Amendment rights because they considered the phone booth as a protected area which violated his rights to privacy. (Stewart , P. & Supreme Court of The United States.) My last example would be when a law enforcement officer not being able to provide enough proof to convince the judge that it is necessary to conduct a search and seizure at a home. Since they don’t have enough proof this could further delay the investigation.
