MEMORANDUM To: Michael Beshears From: Kari Price Date: 8/13/2023 Re: CJ 510, Module Six Memorandum I. INTRODUCTION I was recently promoted to executive officer in the police department. My direct supervisor is the agency head. The brother of said agency head is also employed at the department. I am unsure if the brother is my subordinate or if he is in a supervisory position like mine. The brother has been accused of several instances of excessive use of force in the past. All of the complaints have been dismissed. There are also several other officers who have higher than normal complaints for excessive use of force. II. MAIN SUBJECT MATTER OF MEMO I feel the ethical dilemma will become important if the brother has another complaint. I feel that officers in a subordinate position will have a hard time coming forward with complaints or evidence against the agency head's brother. There is already a pervasive characteristic in many police departments; the unwillingness of officers to report colleagues who violate the rules (Westmarland & Rowe, 2018). According to Westmarland, this unwillingness of officers to hold their peers accountable is known to the public as the "blue code" or the "blue line." It often causes public mistrust of the police (Pollock, 2022). As a leader it is my responsibility to help the department maintain its integrity and honor. I should encourage my fellow officers to report misconduct to me or one of the other supervisors. I understand this will be hard to do in the case of the agency head's brother. I will encourage the reporting and try to give officers a safe place to discuss their concerns. I will also tell my supervisor about the issues presented to me. I am afraid that in the case of the brother my concerns will not be taken seriously though. I would also need to report the concerns to the agency head's supervisor. This would help to ensure transparency. I feel that nepotism in this situation is another ethical dilemma. Nepotism "places loyalty and obligations to one's family over obligations to one's employer" (Pearce, 2015). It creates dilemmas in the organization and hopefully this department has policies in place to prevent the agency head from making decisions regarding his brother. If there is no policy in place, then the culture of the organization will be negatively impacted. The use of body worn cameras could be beneficial in this case. Body worn cameras can help increase public confidence and police transparency (Pollock, 2022). They may also provide evidence to either validate or refute a claim of excessive force by an officer. I would also suggest a written code of ethics for the department. Often there is no written code and officers are unaware of what is or isn’t an ethical violation (Westmarland & Rowe, 2018). Westmarland found that an ethical code will clear up confusion and clarify what needs to be reported.
