Protecting the civil rights of minorities in the public and private school systems is critical to fostering a safe, equitable, inclusive learning environment for everyone (Jannson, 2020). Title VI of the Civil Rights Act of 1964 directly addresses discrimination in educational settings (United States Department of Education, 2023). Any institution or extracurricular activity that receives any type of federal funding is subject to Title VI and cannot discriminate on the basis of “race, color or national origin” (United States Department of Education, 2023). The Office of Civil Rights (OCR) handles all complaints and enforcement of policy prescriptions (United States Department of Education, 2023). Although private schools do not generally receive federal funding and therefor would not be subject to the provisions of Title VI in that respect, there are likely state and local regulations that address discrimination more broadly that would apply here. It is also important to note that some private schools do receive some government funding under various voucher programs, school lunch programs and other assistance. The U.S. Department of Education does distribute a handbook that addresses regulation of private schools in each state (United States Department of Education, 2009). On a micro level, the establishment and enforcement of anti- discrimination policies must be reviewed and updated regularly to ensure efficacy and equity. Diversity, equity and inclusion (DEI) training for all teachers and staff should also include cultural-competency training.
