1. Identify at least two human rights issues presented. How were these human rights violated? (100-200 words) The human right issue presented was suffering domestic violence. According to the UDHR (1948), the human right that was violated in this case of domestic violence was the right to life, liberty and personal security listed in article 3. Also, her human right of freedom from torture and degrading treatment listed in article 5 was also violated. The speaker lived in a physical and emotional abusive relationship with her boyfriend. She was living in constant fear and torture. Her human right to a dignified life filled with security and free from any torture was violated when her boyfriend knocked her down and she hit her head. Also, her human right of freedom and liberty was threatened when she was ready to leave her boyfriend and he threatened her to not leave him by slitting his wrists. At this point, the speaker felt like she had lost control over her life and constantly worried about her security. United Nations. (1948). Universal Declaration of Human Rights. These social identities and social locations are important to note because it could better help understand the main character and their positionality and how this may impact their power and access to resources. According to Crenshaw (1991), “black women are less likely to report their rapes, less likely to have their cases come to trail, less likely to have their trials result in convictions, and most disturbing, less likely to seek counseling and other support services” (p.11). The main character endured the physical and emotional abuse for a long period of time until she finally was able to confide in her best friend when things got out of hand. She did not mention confiding in the authorities or any support services. Crenshaw reinforces the fact of how many black women, like the main character, are not open about attacks on them. Perhaps the main character felt like her voice was not going to be heard and that her trail would be another that does not result in conviction. Provide your rationale. (100-200 words) The main social justice issue is domestic violence. The state and government have failed in keep all humans safe, specifically black women. The main character did not know any of the warnings sings of being in an abusive relationship and did not contact any support services when things got out of hand either. There is a lack of education and access to resources for women, especially
black women when it comes to domestic violence. As our human right to live a dignified life filled with liberty and security, it is hard to do when we do not know what domestic violence is or where to go to when we are experiencing it. It is the government and state’s responsibility to keep us safe and to positively intervene in both preventing and responding to domestic violence. Domestic violence is not just an individual or a family issue, it is a social justice issue. Develop a rights based and justice informed social work intervention for at least one of the presenting issues viewed in the video. Specify in your response whether the intervention proposed is at the micro, mezzo or macro level and why. (150-250 words) One of the presenting issues viewed in the video was domestic violence. If I were to create a mezzo level rights based and justice informed social work intervention, it would include organizing domestic violence informational groups in the community. Many women do not know the warning signs when experiencing domestic violence. There is not enough information and awareness on the issue. I would involve the participation of survivors of domestic violence to tell their story and inform the community on the warning signs. This would be a setting where the women have a voice, and they can run the group at their pace and at their desire. This would also be a place that offer support services. Women who are experiencing domestic violence would know who to call or where to go to. This community group would work with shelters to help re-locate these women who are leaving an abusive home and do not know where to go. This community group would help women with resources, so they are not afraid to leave their abusive homes. 2. Identify at least two human rights issues presented. How were these human rights violated? (100-200 words) The human right issue that was presented was the main character and his family growing up in inadequate living standards. According to the UDHR (1948), this is a violation of article 25, “Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control”. The main character had grown up with his family not having the security of food, clothing, housing, medical care and necessary social services when his father passed away. His mother was unable to get a job to provide for her family. His family was not provided with the adequate resources to maintain an adequate living standard. Another human right issue that was presented was being given a 45-year sentence for a parole violation. According to the UDHR (1948), this is a violation of article 11 which states, “Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed”. The main character should have received a fair sentence for his parole violation. However, the justice system failed him and gave him a heavier penalty. United Nations. (1948). (100-200 words) The main character is a Latino male who is part of a poor socioeconomic status. These social identities and social locations are important to note because it could better help understand the main character and their positionality and how this may impact their power and access to resources. According to Bannan (2019), “it is harder than ever to organize workers, negotiate workplace conditions, monitor and enforce dignified workplace conditions and ensure the minimal guarantees for worker protections. This is especially true for low-wage workers whose labor has historically been exploited, namely people of color, immigrants, and women” (p.5). As the main character explained, it was not easy finding the right employment to sustain a family of 9 children. His mother and him did not have access to adequate job opportunities. (100- 200 words) The main economic justice issue raised in this video is poverty. According to Navaro (2016), “Inequality in the United States and most other developed nations has risen significantly since the 1980s” (p.10). There is an issue in the United States with inequality when it comes to economics. The United States favors the wealthy and neglects the poor. They focus more on how to get the rich richer rather than focusing on how to get the poor out of poverty. Poverty was a huge contributor to what brought the main character to choose drugs and violence. The main character and his family fell into poverty when his father passed away and there was no longer any steady income. They had the lost the breadwinner of the family. The mother did not have any job experience and all the other kids were too young to work. He was anxious to find a job to help support his family. However, living in poverty did not make it any easier. For the main character to provide for his family he was left with no choice but to choose the only job that was accessible to him and brought a higher income, which was selling drugs on the street. Therefore, I would work with the government and state to focus more on the poor and getting them out of poverty. The ways I can help to do this is by providing the poor with more accessible resources. For instance, such as making jobs more accessible and increasing the pay. Lots of times it is hard for people to find jobs because of all the qualifications and requirements. We should be creating more jobs for people who do not meet these criteria. Also, most of these jobs do not offer great pay. Although we are helping create jobs, what does that matter if they are not offering great pay? Many of these families cannot live off such little income. And that is the reason most of them rely on drug related and violent jobs because it provides them with a greater income. We must create a better system in where poor people can feel included and empowered. 3. Identify at least two human rights issues presented. How were these human rights violated? (100-200 words) The human right issue that was presented was the main character and her family living in inadequate living standards due to the oil drillings placed in their communities. This compromised her and her family’s life and security. The main character at just 10 years old had suffered from extreme nosebleeds that she could not sleep horizontally anymore, was getting MRI’s done, and even had palpitations trying to use heart monitor. According to the UDHR (1948), this is a violation of article 3, “Everyone has the right to life, liberty and security of person”. This is also a violation of article 25, “Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control”. People of wealthier communities are given more preference. You would never see oil and gas wells being placed in wealthier communities. However, lower income communities are given less preference. People of lower income community do not have a voice and are not given a platform either. What is the main environmental justice issue raised in the video? Provide your rationale. (100-200 words) The main environmental justice issue raised in the video is pollution from oil wells causing inadequate living standards for families in the community. According to the video, in Los Angeles County, 3.5 million people live within a mile of an oil or gas well. The main character
expressed how because of this she was experiencing physical health disabilities. And in fact, she was not the only one experiencing these physical health disabilities. All the parents in the community have expressed among themselves their worries about their children growing up with physical health disabilities. According to Erikson (2018), “Decisions that have significant environmental and social consequences are often made without the involvement of those whose interests are directly at stake. For people whose lives and livelihoods often depend on natural resources and are therefore most vulnerable to environmental risks, the consequences of exclusion can be especially severe. Weak access to decision-making may expose poor communities to high levels of pollution, remove them from productive land, and deprive them of the everyday benefits provided by natural resources” (p.5) Unfortunately, families do not have a say in their children’s physical health because no matter how much they take care of their children the environment will fail them. (150-250 words) If I were to create a macro level rights based and justice informed social work intervention, I would hold the state and government responsible for not fully completing their duty bearers on keeping the people of the community safe. They prefer on keeping on with their business then worrying about their people’s health and well-being. Therefore, I would work with the state and government in finding way to shut down oil and gas wells and switch over to solar and wind. As social workers we have the responsibility to help communities dealing with environmental injustices. According to Erickson (2018), “Recognizing nature as an asset to communities’, families’, and individuals’ physical, mental, and social health is essential to contemporary social work practice as we now understand the impact of our natural environmental spaces, including what we eat and the air we breathe, on our human health and vitality” (p.3) We need to find ways to keep our communities safe and not neglect lower income communities along the way. I would continue the main character’s advocacy and letting people tell their stories of how they have been affected by oil and gas wells.
