FAPE Assignment Stephanie RodriguezJauregui EDU219- Characteristics of Exceptional Children Professor Susan Pohorence 12/4/23
FAPE Assignment FAPE stands for Free Appropriate Public Education. It requires that students with disabilities receive an adequate public education that meets their unique needs and prepares them for further education, employment, and independent living (What is and isn't covered under FAPE 2023). The FAPE program ensures that students with disabilities receive an education tailored to their Individualized Education Program (IEP) and that their education is conducted in a Least Restrictive Environment (LRE). The determination of what constitutes FAPE is not solely the responsibility of parents or LEAs; rather, it is a shared responsibility. Mediation or due process procedures may be instituted to resolve disputes between parents and LEAs regarding what constitutes FAPE. These processes allow parents and educators to collaborate and reach an agreement. These procedures are outlined by the Individuals with Disabilities Education Act (IDEA), which outlines the procedures that must be followed in these situations. The LEA is required to comply with federal and state laws and regulations, and parents have the right to appeal any decision they feel is unfair. Providing guidance and support to parents and LEAs navigating disagreements concerning FAPE can be accomplished by utilizing resources such as special education attorneys and advocacy groups.
