Draw from class materials and discussion to provide support for your answer. Scenario #1: Footprints in the Desert Border Patrol officers in Arizona begin to notice human footprints in the desert. Based on these prints, they guess that groups of around 8-20 people are crossing the U.S. border illegally from Mexico and walking to an isolated pickup spot on a nearby highway. After some more detective work, they develop a theory around when these pickups are taking place. Early one morning, they pull over a driver whom they suspect of being the smuggler. The officers ID themselves and announce that they’re performing an immigration check. In the passenger seat is a man whose shoes match a footprint found earlier in the desert. In a camper attached to the truck are six people who are in the country illegally. The driver and the passenger are arrested and charged with six counts of “transporting illegal aliens.” Is this stop Illegal? Yes or No Explain. No, this stop is legal because border patrol is suspected of illegal transportation of illegal aliens. They had seen human footprints on the U.S. border from the Mexico border. Which gave them suspicion. The government does not have to have suspicion, but these detectives waited till they did. The government has all rights due to national security interests.
Community Relations Assignment #2 Name: Heather Whitaker_ Scenario #2: The High-Crime Area A man is standing in a Chicago neighborhood known for heavy narcotics trafficking. He’s holding an opaque bag when he sees police officers enter the area. Suddenly, he begins to run. The officers catch him, pat him down for weapons and find a .38-caliber handgun. The man is placed under arrest and convicted of unlawful use of a weapon by a felon. Is this top Illegal? Yes or No. Explain. No, this stop is not illegal. The police need to have reasonable suspicion to stop and frisk someone. The police must have enough suspicion in whichever court they go to, to make sure the court accepts the case. The man was in a heavy crime area known for drug trafficking and he was holding a non-transparent bag. He then started to run once he spotted the police. The man backing away/running away from an officer gave a justifiable reason to frisk according to the 4 th amendment. How do these scenarios affect community and police relations? These scenarios affect the community and police relations because if the community does not understand why they are getting frisked then they could profile the police. The community could continue to distrust the police even if the ones they frisked and then arrested were in the wrong. Some communities also disagree with those who are illegally coming into the U.S. being detained so it could cause uproar in those communities with that scenario.
