Idea Rights Children have rights in school, and they need to know those rights so that they can defend themselves in school. Students with disabilities have the Individual with Disabilities Education Act (IDEA) that prohibits discrimination towards those who are disabled. In IDEA, the government controls all funding of services that are related to special education. Students need to be able to qualify by meeting the criteria to get extra assistance in school. In contrast, the 504 of the Rehabilitation Act prohibits those receiving federal funds from being discriminated against. The similarity is that both aims at making sure children are not discriminated against in education. As stated in the article, teachers need to have a clear understanding of both to assist their students more. Also, the 504 rule is to ensure that schools comply; if they are not, the Office of Civil Rights can remove funding. The main goal is to help students with disabilities receive services so that tomorrow they are more prepared. When parents are requesting services, I plan on having them do a questionnaire and a grade-level assessment to determine if the student needs assistance. To be eligible, the child must show development delays in certain areas, such as physical development, communication development, cognitive development, and social-emotional development. So, typically, kids in a category of disability such as students with autism, speech or language impairment, traumatic brain injury, or other disabilities must get services from the schools. Also, the parent must give the school district consent for assessing the child before the school can determine if the student qualifies. The assessment needs to show that the child needs services to be successful in the school. For students to be eligible under section 504, there needs to be the presence of a learning disability that prevents the students from performing at the
Idea Rights grade-level standard. Making a comparison for the type of services a student needs is by comparing IEP and 504 plans based on the children’s specific needs. If parents request accommodations, I plan to use the 504 plan because it aligns more towards those services. For instance, a child who needs an IEP has a blueprint plan and standards that the child will be working towards before the subsequent evaluation. In a 504 plan, the blueprint describes the school what it will be doing to make sure the student is making progress and removing barriers that might prevent progress. The common reason schools face challenges regarding 504 and or IDEA is because they don't have the resources or the accommodations to meet the needs of students. For instance, there was the case of a student in Poole v South Plainfield where a high school student did not have a kidney and wanted to play in the wrestling team, but the school was not allowing him. So, the courts denied his motions, and he could not participate because he had graduated, and the school's medical examiner argued that a student with one kidney could not play wrestling. Another case in this reading is Mills Vs. Board of Education, in this case, seven children with special needs brought a case against the school board because it did not accommodate their needs. The ruling was that even though the school did not have the financial means, its job was to provide a school suited for the needs of the students. The main goal is to help students with disabilities receive services so that tomorrow they are more prepared. It won't look nice for a school to not take good care of their next generation by not giving them the need to be successful early. Children with

Idea Rights special needs are very bright, and they need a society that loves to take care of them. Schools faced many challenges, like not having the funding to make sure students succeed. When they accept a student with disabilities, schools need to make accommodations to move around to class much more accessible, especially those in a wheelchair. References LaMorte, M. (2012).
