In psychotherapy, there is a general duty of confidentiality that is considered essential for establishing trust and facilitating open communication between the client and therapist. CAP further emphasizes the importance of maintaining confidentiality unless there are compelling reasons to breach it (College of Alberta Psychologists, 2022) However, there are situations where therapists may be ethically and legally obligated to breach confidentiality. Some examples include Imminent harm to self or others, abuse of vulnerable populations, legal mandates, and cases of legal consent and defence (Darby & Weinstock, 2018). In the case presented, the client has shared information that might cast doubt on the accuracy of the conviction. While it's crucial to respect the client's confidentiality, ethical considerations may warrant further exploration or action. In this case, where someone innocent has been sentenced to prison there is a clear and imminent risk of harm. Harm is defined as both physical and psychological dimensions of harm (Canadian Counselling and & Psychotherapy Association, 2021). Practicing responsible care prompts psychologists to diligently assess harm and benefits also for those indirectly involved in their activities (Canadian Counselling and & Psychotherapy Association, 2021).
