3-1 Practice Activity: Victim Impact Statement 2 Purpose and Effect of Victim Impact Statements As someone who has been through the investigation and court process, I know firsthand how impactful victim impact statements are to survivors of crime. For my whole childhood, I felt like my voice had been silenced and for the first time it was being heard. Being able to say in my own words how my abuse impacted me was more healing than I realized at the time, and that is the whole goal and purpose of victim impact statements (VIS.) According to the U.S Department of Justice, Criminal Division, VIS statements allow victims to express in their own words how they, their family, and others who were close to the crime, were impacted or affected by it. Many victims of crime have also found that giving these statements have provided them some sense of closure. (2023) Victim Impact Statement From The Perspective of The Victim (Scenario 1) It was your typical Saturday afternoon, it was a nice sunny day, we were taking what started off as a relaxing family drive up the coast. But, my life was forever changed that day due to the actions of the defendant. While my family and I chose to take a nice drive, he chose to get drunk and drive. One minute I remember riding with my family, and the next I’m waking up in the hospital being told my husband and two children are dead. Due to the defendants carelessness and poor actions I have lost everything and my life will never be the same. How does one heal when their family was taken from them but the person who took their lives walked away unharmed? Because of their actions my twins will never get to grow up, go to school, graduate, create new memories, or have children of their own. He robbed me of my future with my husband, whom I now won’t grow old with like we always planned. While I can understand that the defendant did not get into his car with the intention to kill anyone, that is what he did. He made the conscious choice to get drunk, which impaired his decision-making, causing him to end
3-1 Practice Activity: Victim Impact Statement 3 up behind the wheel of his car. Nothing anyone can ever do can bring my family back, or my life back. All I can ask from the court is that the defendant gets the maximum sentence. He is a danger to society and needs to get sober and rehabilitate himself so hopefully one day he can be a productive member of society. I hope they take this time to reflect on their actions and the damage they caused, so they don’t cause this kind of pain to any other family. Thank you.
