CHAPTER 10 DISCUSSIONS and CASE STUDY 1. Please view the following video: What is the significance of the HIPPOCRATIC OATH (HINT: what does it have to do with ETHICS?) Written in the 5th century B.C., the Hippocratic Oath is one of the oldest documents in history. While the creators intended it to be a binding covenant, modern doctors see the oath as a promise to uphold the art of medicine and act in patients' interests. These include the principles of medical confidentiality and non-maleficence. Why do you think the HIPPOCRATIC OATH has been an oath taken by all physicians at the end of their training? Because if they fail to conduct their business with ethics, they can be held accountable. 2. Intertwining ethics, morality, and laws. Please view this video: https://www.youtube.com/watch?v=Xki2fRA0bY8 Define each according to the video: ethics, morality, law. Ethics is a branch of philosophy that answers the question “What should I do?”. Ethics is a process of reflection in which people’s decisions are shaped by their values, principals and purpose, basically, what a person to believe what is right, wrong or meaningful. Morality refers to informal framework of values, principals, beliefs, customs, and ways of living. Usually the process of moral formation is unconscious. The way you are raised, the people you have around you and the customs, etc., usually will be what will shape your morality. Laws are formal rules that govern how we behave as members of a society. They specify what we must, or more frequently must not do. Those laws are upheld and applied by the court and state system, creating a standard of behavior. There is more to ethics than law and ethics and covers a lot of things that laws do not. Discuss how ethical views shape our laws. Ethics are principles and values, which together with rules of conduct and laws, regulate a profession, such as the legal profession. They act as an important guide to ensure right and proper conduct in the daily practice of the law. Areas covered by ethical standards include: Independence, honesty and integrity. 3. Case Study: AVOIDANCE OF PHYSICIAN MALPRACTICE Please watch the following video and answer the questions attached: https://www.youtube.com/watch?v=Y11TaOZXxuM&t=197s
CHAPTER 10 DISCUSSIONS and CASE STUDY Discuss what can physicians do to practice “defensive” medicine to lower the risk of medical malpractice? List and describe resources are available if the physician is indicted for medical malpractice? Litigation Education Retreats, for members of The Doctors Company, help doctors facing lawsuits deal with the stress of litigation and become more effective and assured in court. Discuss your opinion about why there is increasing medical malpractice in the U.S.? Medical providers have been pushed to the limit, with hospitals often being understaffed, staff members being overworked, and limited supplies. These issues have led to an increase in general negligence and malpractice. Also, the way physicians make money is quantity over quality, so unfortunately there are many doctors out there just trying to see patients after patients just to make more money, instead of take the time with each patient to exam and listen to the patient.
