Racism within the Criminal Justice system is a big issue at hand, and in some instances never left
the United States. The argument relates to my major in every way. I am a Criminal Justice major,
and my hope is for a better system to protect our people, but before the system can be fixed, we need to address the issues at hand that prohibit the system to grow. This topic is debatable. Not everyone can believe that the system is racist, especially if you are coming from a place of privilege. For example, The American Bar Association has a joint initiative to reduce implicit bias in the judiciary (American Bar Association, 2020); this includes conferences, trainings, and publications (e.g., Redfield, 2017). Some courts have implemented measures to address jurors’ implicit biases; these include providing jurors with instructions about recognizing one’s own biases or using expansive voir dire to expose biased jurors (Kirshenbaum & Miller, 2020). In addition to recognizing that jurors might be biased, many judges recognize their own potential for bias. Several use bench cards to help them make logical decisions and reduce bias (Perez et al., 2017). These cards guide judges by asking them to answer a series of questions about factors that should influence their decisions—which theoretically reduces their reliance on factors that should not influence them. Some potential challenges I might encounter with proving racism within the Justice System is The Hostile audience, being that they will be in strong disagreement with my argument. I believe I will have a much difficult more time proving that the bad outweighs the good in this majority. One goal I hope to accomplish at the end of this essay is to
give the hostile audience a better understanding on my argument and hopefully convince some readers to take a second look or think twice when it comes to racism within the justice system and what you can do to help. This essay will need strong supporting evidence and data to help my argument be more effective. Three key points that will help support my argument is to use cases for my supporting evidence that are relevant to the topic at hand. For example, Loving v. Virginia, Civil Rights Act, Brown v. The Board of Education. Some other key points that will help prove my argument is using these three key points: Police stops, Institutional racism, and the war on drugs. The first source I will be using is There’s overwhelming evidence that the criminal justice system is racist. Here’s the proof by Radley Balko. This article delves into how the criminal justice system was never meant to be fair, at least for people of color and that it is a modern Jim Crow. The author further explains how the criminal justice system will put two different sentences for the same according to some of the studies recorded in the article. This article will help me further prove the problem with racism withing the Justice System. The second source I will be using for my argument is for the opposing view: Justice for The System There is no institutional racism in our courts and police stations By Ian Tuttle. The author explains in this article how the justice system is fair as far as policing is involved. According to the data in the article, most of the populations in prisons for crime is the African American community. As far as other crimes go Caucasians make up the majority. This article delves into the war on drugs and how the system was fair in terms of getting drugs off the street. This will help support the counterargument as to why the Criminal Justice System is fair rather than racist My final source, I will be using is Racism in the War on Drugs by the Gateway Foundation. The article. The article states Racism has been embedded in the United States war on drugs since its inception. The war on drugs has had little impact on drug use rates or public safety, but it has
resulted in a skyrocketed prison population, especially among communities of color. The impact of the war on drugs has been mass incarceration, increased felony charges and lives disrupted by drug criminalization. This will prove how through poor brown communities, The drugs are more susceptible, rather than in predominately white neighborhoods. There is a heaver chance of gang activity in poor communities and crime, which follows with a heavier police presence. This further proves how environmental racism follows like a domino effect and proves the racism within the justice system. I plan to effectively integrate evidence by using data provided by the sources and studies as well to back up my point. I plan to add quotations while effectively crediting the sources.
