Eric Davis Educational Leadership: Western Governors University D022: People and Talent in Education Task 4 Gregory Thomas 12/10/23 A1: Overview of Pattern of Behavior Incident Summary: Teacher: Mr. Lee Grade Level: Fourth Incident Dates: Week of November 27th, 2023 and December 4th, 2023 Over the last two weeks, Mr. Lee has demonstrated a pattern of tardiness while completing his required recess and bus duties. During the week of November 27th, 2023, it was observed and noted that Mr. Lee was late on three separate occasions for his assigned recessed duty. It was then observed and noted that Mr. Lee was late twice during the week of December 4th, 2023, for his assigned bus duty. The exact dates of his tardiness are documented below: • On 11/27/23, Mr. Lee was 5 minutes late for recess duty. • On 11/28/23, Mr. Lee was 10 minutes late for recess duty.
• On 11/30/23, Mr. Lee was 8 minutes late for recess duty. On 12/6/23, Mr. Lee was 7 minutes late for bus duty. • On 12/8/23, Mr. Lee was 9 minutes late for bus duty. The pattern of tardiness during the weeks of November 27th, and December 4 th , 2023 is out of character for Mr. Lee. Mr. Lee who has worked for our school for three years and has always followed our duty schedule without issues, nor has he committed any other violations during the last three years. All things considered, our staff must adhere to their assigned duties to ensure our students’ well-being and safety. Mr. Lee has potentially compromised our students’ safety and well-being by being late multiple times over the last few weeks. A2. Violation of District Policy or Contract Language Mr. Lee’s pattern of tardiness during the weeks of November 27th and December 4th, 2023, has violated Caldwell School District Policy (CSD) 5475. CSD Policy 5475 states that the purpose of this policy is to set forth Caldwell School District’s policy and procedures for handling employee absences and tardiness to promote the efficient operation of the Caldwell School District. CSD Policy 5475 also clearly states that employees are expected to report to work on time, and that unexcused tardiness or early departures can result in disciplinary action, including termination of employment. Mr. Lee had five separate observed and documented incidents of being tardy during the weeks of November 27th and December 4 th where he failed to adhere to CSD’s expected standard of punctuality. Mr. Lee’s pattern of tardiness during the
weeks of November 27th and December 4th, did not promote efficient operations at our school and potentially compromised the safety of our students. Taking in to consideration all the facts and adhering to CSD Policy 5475, Mr. Lee could face disciplinary action. A3. Approach to address the Behavior I would first like to investigate why Mr. Lee was tardy five times during the weeks of November 27th and December 4th since he has always followed our duty schedule in the past without any issues and has not had any violations during the last three years for anything. I will follow these steps when investigating: 1. I will ensure that he was not notified via email, voicemail, etc., that he could not perform or would be late for his recess or bus duty.  2. I will ensure nothing has changed with our school’s schedule, his teaching, or the duty schedule that is causing him to be tardy to his recess or bus duty.  3. I will also make sure he clearly understands his recess and bus duty responsibilities. Next, Mr. Lee will be allowed Due Process as granted by the Fourteenth Amendment, as well as being a tenured teacher in Idaho since he is in his third year of teaching. A calendar invite and an email with the incident summary report and CSD Policy 5475 attached will be sent to Mr. Lee regarding his tardiness pattern during the weeks of November 27th and December 4th. It is important to hear his side of the story to understand why he has been late five times during the weeks of November 27th and December 4th since he has never had a problem in the past. If it is personal, we have counselors just for teachers through our district insurance standing by any hour, day, or night to assist him. I will ask Mr. Lee if he has any questions about the incident

Using CSD Policy 5475, I also explain the possible next disciplinary steps that could be taken if the pattern of tardiness continues.  Then, Mr. Lee and I will develop an action plan; since he will have a voice in creating it, he is more likely to follow it. The plan could include taking him off of recess duty, bus duty, or both, or we could rework part of his schedule or develop another plan to ensure his success and our students’ safety moving forward. We will put our plan in writing and sign it. The last thing I would do is make sure that he has copies of all the documents from our meeting, such as the incident report, a copy of CSD Policy 5475, our signed action plan, the duty schedule and our documented notes from the conference. I will also follow up with Mr. Lee through the next few weeks to help ensure our action plan is successful.  A3A. Justification of Approach The goal when approaching Mr. Lee's tardiness pattern was to ensure that I followed our district policies, ensured our student's safety, investigated the situation, and ensured it didn't happen again. The investigation involved checking for any communication that may have indicated an inability to fulfill duties promptly and making sure there were no scheduling changes within the workplace or role that could have contributed to tardiness. The purpose or justification for meeting with Mr. Lee and the approach of using CSD Policy 5475 is to adhere to Caldwell School District policies. It also ensures that he understands
CSD Policy 5475 and his responsibilities regarding his duties. Following CSD policies also allows me to avoid bias. The meeting followed due process and allowed Mr. Lee to have a place where his voice was heard, the opportunity to share any relevant information or facts that he had on his behalf and disciplinary action to be taken if needed. The meeting allowed me to get to know Mr. Lee better and understand what had changed during the weeks of November 27th and December 4 th . The meeting also ensured we all know our responsibilities. I decided that the only disciplinary action that would be taken was to make an action plan and a verbal warning. The action plan allows us to create a positive change moving forward to ensure Mr. Lee's success and our students' safety. The action plan includes me following up with Mr. Lee’s helping ensure the success of our action plan and demonstrate the school’s commitment to supporting Mr. Lee while upholding our policies. To avoid any bias or favoritism, every step taken was in line with the CSD policies and procedures, all interactions were documented, and copies of all relevant documents were provided to Mr. Lee. This approach centers on fairness, transparency, and support, reinforcing the importance of adhering to duty schedules for our students' safety and well-being. All parties understand what is expected of them regarding recess duty, bus duty, and other future duty responsibilities. Mr. Lee is also aware of the following disciplinary actions per CSD Policy 5475 if his pattern of tardiness continues. Mr. Lee and the administrative team felt his meeting was positive, left happy, and clearly understood the plan, next steps, etc. Again, Mr. Lee received copies of all the documents from our meeting, such as the incident report, a copy of
CSD Policy 5475, our signed action plan, the duty schedule, and our documented notes from the conference.
