1. Briefly explain the obligations of managers and business owners in regard to work health and safety. For your employees, you must provide and maintain a working environment that is safe and free of risks to health, so far as is reasonably practicable. As part of this you must, so far as is reasonably practicable: i. a first aid plan ii. an emergency plan iii. display the "If you get injured at work" poster iv. regular maintenance of industrial plant and safety v. putting processes in place to reduce health risks in operations the use, handling and storage vi. providing adequate facilities for worker’s welfare vii. a workers compensation policy viii. a return to work plan. ix. Keep workplaces that you manage and control in a safe condition, free of risks to health (for example, ensure fire exits aren’t blocked, and the worksite is generally tidy). x. Provide suitable facilities for welfare at any workplace you manage and control. xi. Give your employees the necessary information, instruction, training or supervision to enable them to do their work in a way that is safe and without risks to health. 2. Outline at least two Work Health and Safety (WHS) responsibilities of workers while at work. All workers are responsible for the WHS impact of their own actions. They also have a duty to make sure their work is carried out in line with WHS Management Procedures and any applicable legislation. More specifically, workers must: i. take reasonable care for their own health and safety ii. take reasonable care for the health and safety of others who may be affected by their actions in the workplace iii. co-operate if the PCBU needs them to do something to comply with a legislative requirement iv. not intentionally or recklessly interfere with or misuse anything provided at the workplace in the interests of health, safety or welfare v. inform their company of any allergies or medical conditions that may impact on their health and safety 3. Identify and document the title and date of the WHS/OHS Act and Regulation for the state in which you are located. A code of practice provides detailed information on how you can achieve the standards required under the work health and safety (WHS) laws. Discuss the purpose of a code of practice and give an example of a code of practice, including its title and key purpose. Code of practice is a practical guide to achieving the standards of health, safety and welfare required under the WHS Act and the Work Health and Safety Regulations 2011 (the WHS Regulations). It applies to anyone who has a duty of care in the circumstances described in the code. The purpose of code is to ensure industry compliance with an agreed upon set of objectives that benefit workers, employers and consumers. For example: Franchising Code of Conduct The Franchising Code of Conduct is a mandatory industry code that applies to franchisors, franchisees and prospective franchisees of a franchise agreement. Therefore, it imposes obligations to all franchise agreements that were entered into, renewed, extended or transferred on or after 1 October 1998. The Work Health and Safety Regulations 2011 state how to manage risks to health and safety with regard to hazardous manual tasks. The hierarchy of control creates a systematic approach to managing safety in your workplace by providing a structure to select the most effective control measures to eliminate or reduce the risk of certain hazards that have been identified as being caused by the operations of the business. The hierarchy of control involves the following steps: 1. Elimination – removes the cause of danger completely. 2. Substitution – controls the hazard by replacing it with a less risky way to achieve the same outcome. 3. Isolation – separates the hazard from the people at risk by isolating it. 4. Engineering – using engineering controls, i.e. Making physical changes, to lessen any remaining risk, e.g. redesign a machine by adding safeguards. 5. Administration – use administrative controls to lessen the risk, e.g. install signs, and rotate jobs. 6. Personal Protective Equipment (PPE) – require your employees to wear PPE, e.g. provide gloves, earplugs, goggles, iridescent vests. 8. List three reasons why it is important to consult with staff when implementing or reviewing WHS procedures and policies in the workplace.
