e Petit Fleur is a French style bakery that specializes in creating gourmet pastries, cakes and sweets for celebrations and events. They are quite well known for having high prices and equally high quality produce. Lily-Mae is getting married and is organizing the food for the celebration. She’s visited a few cake shops, bakeries and specialist event caterers, but she hasn’t found anything she likes. As she is driving home from a tasting appointment, she passes Le Petit Fleur and notices an enormous sign in the window that reads, “Today only - 50% off all orders!” Lily-Mae cannot believe her luck. Quickly she turns into the carpark belonging to Le Petit Fleur and hurries inside. The smell of sweet aromas hits her the moment she walk into the door. She’s never even tried to get in touch with Le Petit Fleur, knowing that they are very high priced, but with a 50% discount she might just be able to do it. She immediately spots a cake on display and is enchanted. The color, decorations and details are perfect for the theme of her wedding. After a few minutes, Jean-Paul approaches her and introduces himself as one of the owners of Le Petit Fleur as well as being one of the bakers. Lily-Mae immediately jumps in, “I would like one of these cakes for my wedding, with the 50% discount.” Jean-Paul shakes his head. “I’m sorry, but we have stopped the special. There were far too many orders coming in and we were worried that our supplies would run out!” Lily-Mae is surprised. “But there is a sign in the window that says 50% off all orders today.” Jean-Paul walks to the window and pulls down the sign. “I forgot to take it down this morning”. a) Lily-Mae is very upset and wants to know if Le Petit Fleur must give her 50% off her order. Advise Lily-Mae. Jean-Paul can see how upset Lily-Mae is, so he quickly tells her that even though the sale price is no longer available they can complete they can offer her a smaller size cake in her budget. While Lily-Mae isn’t pleased with this, she decides to go ahead with the order as she is very keen on the Le Petit Fleur. She sits down with Jean-Paul at one of the bakery tables to address the fine details. She informs Jean-Paul that the cake is the centre-piece of her wedding and now that the cake will be a smaller size, she would like to go with the Raspberry cake, rather than the chocolate cake, as this matches the decorations at the event hall, her dress (which has small decorative beads that resemble berries on it) and also the berry-themed gifts she will be giving to her guests after the wedding. She also mentions that the cake needs to be made with organic berries and she would like the frosting to be in swirls rather than dollops. Jean-Paul writes this all down and they both sign their names. Lily-Mae then pays Jean- Paul a $50 deposit. On The day of Lily-Mae’s wedding the cake is delivered and Lily-Mae is aghast to find that the cake is in fact a chocolate-flavoured cake and the outside of the cake is also chocolate, rather than the berry style cake she wanted. The frosting is also dolloped rather than swirled. A card is included in the delivery box from all the suppliers that Le Petit Fleur have used in order to make the cake. Lily-Mae notices that the raspberries are from Little Red Farm and the logo on the card says ‘always organic’ underneath the farm’s name. Little Red Farm operates in Lily-Mae’s community and she has been to the farm multiple times, including last week to buy Jam. She knows, for a fact, that the farm is not organic. This is a blatant lie by Little Red Farm and it means that some of her guests won’t be able to eat the cake at all as it is not fully organic. b) Lily-Mae would like to know what recourse she has against both Le Petit Fleur and Little Red Farm for the wrong flavor cake (and corresponding decorations on the cake), the frosting issue and the organic raspberry issue. Advise Lily-Mae.
