How does Dr. Lawrence Moore’s act illustrate the four D's (Duty, Dereliction, Direct Cause, Damages)? Dr. Moore, a psychologist employed at Cowell Memorial Hospital at the University of California Berkeley, confined in by Prasenjit Poddar that he had intentions to kill Tatiana Tarasoff. Dr. Moore notified the campus police, who after questioning Poddar released him as they believed him to be rational. When Ms. Tarasoff returned from Brazil, Poddar killed her. Dr. Moore did not inform the police of Ms. Tarasoff’s life being in danger. Mental health professionals have a duty to protect individuals who are being threatened with bodily harm. This was Dr. Moore’s duty to Tatiana Tarasoff being that Dr. Moore knew what Poddar’s intentions were. I thoroughly believe that Dr. Moore did not perform this, because he did not want to warn Ms. Tarasoff about Poddar and his intentions. Then we have the campus police who failed to detain or to turn Poddar into the police for further questioning. Dr. Moore’s superior directed him to destroy all his notes of counselling and no further action should be taken to detain Poddar. This is a form of dereliction of duty for both Dr. Moore and his superior. Destructing the notes from the meetings and counseling’s was completely threatening to Poddar’s care and treatment. This was a violation of the direct care of the patient. This was also a violation with the direct cause of Tatiana Tarasoff’s death. Poddar was found convicted of second-degree murder, his conviction was appealed and overturned. Dr. Moore and his superior was the direct cause of death of Ms. Tarasoff as they did not warn her of Poddar’s intentions to kill her. This was the duty of Dr. Moore and he failed to follow through on that duty. The dereliction is when Dr. Moore’s superior directed him to destroy all of his notes. The direct cause is wrongful death of Tatiana Tarasoff. She was not warned about Poddar and his intentions and that resulted in wrongful death. The damage that were done were how this happened. The damage is because of their failure of the duty.
