Week 5 Do all US citizens and foreign nationals, regardless of if they have a criminal conviction, have equal rights in the United States? Should foreign nationals be entitled to the same Constitutional Rights? Based on the Annenberg Civics Knowledge Survey, list two questions that you believe would be difficult to answer. Provide the questions, the answers, and why each of them might be difficult. Hello Class, Since the events on 9/11 and the implementation of the USA PATRIOT ACT there were raised concerns about if all citizens receive the same rights regardless of if they are a foreign national or a criminal. The heightening of the war, former President Bush said that if someone comes into the U.S. illegally, they should not be allotted the same rights as American citizens. Contrary to those statements, all US Citizens and foreign nationals do have equal rights in the United States. The “Due Process Clause” states that all person’s inside the U.S., regardless of if they have a criminal conviction, have the right to all rights. In conjunction of the “Due Process Clause”, the Fourteenth Amendment also states that the state should not deprive any person of life, liberty, or property (Cole, 2010). I do believe foreign nationals should be entitled to the same Constitutional rights. It is immoral to deprive foreign nationals the same Constitutional Rights due to their race, religion, or ethnicity. The United States is not like any other country and foreign nationals travel to the U.S. in search of better schooling, work, medical treatment and more. We should not deprive someone their rights due to them being from another country. Q: How well do Americans Understand the Constitution? A: There are percentages that are reiterated for different types of statistics. For example, 78% of Americans are aware of the first ten Amendments of the Constitution while only 13% of Americans are aware that it was signed in 1787. Only 38% could name the three branches of the U.S. government. Anyone can make assumptions on why Americans lack the understanding of the Constitution, but I believe its due to the education system where that person grew up. My school briefly covered the Constitution, and it was not until I got into a Law Enforcement background where I had to do my own personal research. Q: What is the right to petition the government? A: The First Amendment. I feel like this is a hard question to answer because when you ask someone about the First Amendment, the first thing that someone thinks about is “Freedom of Speech.” There are other right associated with the First Amendment other than Freedom of Speech.
