Hello class, The three types of discrimination that I chose are Pregnancy, age, and religious. Of the three discriminations that I chose, I’m only familiar with age discrimination. Pregnancy discrimination occurs when a woman, either one that is applying, or an employee, that is treated unfairly because she is pregnant, childbirth, or due to a medical condition that results from pregnancy or childbirth. Pregnancy discrimination is covered under The Pregnancy Discrimination Act. The Pregnancy Discrimination Act makes it illegal to discriminate against a pregnant person during any phase of employment. This pertains to hiring, pay, job assignments, promotions, training, fringe benefits, leave or layoffs. It is applicable if you are pregnant, have been or may become pregnant and if your employer has at least 15 or more employees. The act also provides the individual with the right to work adjustments to allow you to do your job. These are the same rights that is afforded to employees with disabilities. Age Discrimination is defined as discriminating or harassing an individual because of their age. The Age Discrimination in Employment Act or ADEA, makes it illegal to discriminate against individuals that are 40 years of age and older. Although it covers people over 40, the law does not protect those workers that are under 40. Although it is illegal for employers to favor older workers over those that are younger. It also only applies to private employers with 20 or more employees, state and local governments, employment agencies, the federal government, and labor organizations. Just as under the Pregnancy Discrimination Act, the ADEA also pertains to hiring, pay, job assignments, promotions, training, fringe benefits, leave, layoffs and form or period of employment. In addition to the ADEA, The Older Workers Benefit Protection Act of 1990 (OWBPA) bans employers from denying certain benefits to older employees. Employers can reduce certain benefits based on the age of the employee, but it cannot incur a greater price than it would to provide benefits to younger workers. Finally, Religious discrimination occurs when employers treat employees or applicants harshly because of their religious beliefs. Additionally, it includes treating individuals harshly because they are married to or associated with someone of a certain religion. Religious Discrimination is covered under Title VII of the Civil Rights Act of 1964. It not only covers hiring, firing, or other conditions of employment, requires the employer to provide reasonable accommodations as it pertains to an employee’s religious beliefs, practices or adjusting the workplace environment so that an employee can practice his or her religion. This includes job reassignments, lateral transfers, or allowing for their dress or grooming in order to accommodate the employee’s religious beliefs and practices. Employers are only required as long as it doesn’t cause a hardship to the business. Hardships could be in the form of cost, compromises to the safety of the workplace, inefficiency, if it causes others to have to do more than their share of hazardous work or if it violates or infringes on the rights of others. Title VII also makes it illegal for an organization to segregate employees due to their religion. For example, a department store cannot reassign a salesperson to a position away from customers because of their religious grooming or dress. Discrimination comes in many forms, and some of them we may not look at as being discrimination. It sometimes appears that we are desensitized to discrimination until it affects us or our friends and family. We need to remember that we are all our brother’s keepers.
