If retardedchicken had to fill out an ethical argument against CD piracy that relied on perennial duties or Kant, he would say that piracy abuses property rights or the even simpler question is if CD is even copyright protected. Retardedchickens best bet would be how to use the CD and if it is really breaking copyright. This can be decided by selling
the CD for personal benefit or to create a copy of it for friends which is still a violation where income will be prevented. Now, if they were to make a copy for the personal pleasure of simply listening to music then this is allowed. 2.
The liberations argument against retarded chicken would be that libertarians strongly think that patents are highly important to prevent copyright infringement. If there was a patent in place, retarded chicken would not have been in the situation they were in. This also protects a libertarian from the competitive market. This scenario involves two partis, overstand and retarded chicken. Obviously, overstand owns the original copy, libertarians’ argument here is retarded chicken is against the pirating activities. Also, Property rights or contractual obligations are the primary fight here. Libertarians strongly
agree with property rights and even though overstand might be the original owner this right to use does not correlate with the right to copy since it can violate the creation of property rights. As for contractual obligations, this disc was purchased with specific
arrangements which would help libertarians argue the contract agreement. And Overstand
CD might be in a contract breach. 3.
A libertarian would believe that a company producing CDs has a right to put a code in it to make copying possible. They believe that the content creator has the right to protect their patents and copyrighting and believe that the manufacturer is entitled to create a code because they strongly emphasize the dignity of everyone. 4.
Clone CD is specifically created to help pirates work around copyright protections that manufacturers put on their discs. Pirates can do this because the cloned CD is the same copy of DVDs created by a certain software. The Clone CD is more than capable of creating a fallback option of the data on CDs with very little attempt. As for the libertarian’s case for protecting them, Kant acted as the more ethical case since they backed free trade. Kantian ethics are based around a categorical imperative. One should always respect others and creating the clone CD was unethical. Therefore, the Kantian case is the strongest because a person is supposed to purchase a CD without pirating it. To make financial gain on someone else’s hard work is simply unethical. 5.
I believe there should be ethical codes to follow against this tone of this discussion. When
arguments happen via the internet people act more than what they really are. The negativity that surfaces online is usually unethical but powerful. We should never believe what we see online, because it seems everyone has an opinion and nothing factual. Facts are what people need to follow and positivity should be spread more than negativity but that is simply not the case in this world. Guidelines I would use to prevent negativity online would be setting up a monitoring system where if language gets out of line, then that person should be flagged and warned. You see this in socia
l media nowadays where
warning signs are sent before accounts become deactivated. The same rules should apply to this case.
