CJ 140 Module Seven Practice Activity Template Scenario: Would you consider this setting to be formal or informal? How is this setting formal/informal? How does the setting affect the interviewee and his or her willingness to share information? How does the setting affect the interviewer? You are a patrol officer sent to investigate a shoplifting incident. You arrive at a local shopping mall, where a 15-year-old juvenile male has allegedly stolen a video game console. The juvenile suspect is being detained in the mall security office. I would consider this to be informal because although it IS a security office, it isn’t private and the minor also cannot be interrogated without his parents present. Security officers also come and go and often there is access from the public to these offices for complaints and concerns , which further adds to the lack of privacy. I think this setting would create a chaotic vibe to the situation, as it is likely a busy area with many security officers around him. Without his parents, and knowing what he stole was a larger priced item and is seen far more serious than petty theft, he could be very nervous and seeking comfort from his parents or from a quieter location. Panic often scrambles the mind and doesn't make for the best-detailed recounting of events. This setting can also create issues in getting an accurate reading of the interviewee’s body language and also doesn't allow for a secure interrogation. You have scheduled an interview with a 12- year-old female who has filed a report with your agency that she has been sexually abused by her mother’s live-in boyfriend. She will be arriving at your location in the care and custody of her aunt, who has temporary custody of her. This would be considered a formal setting, as it would be in a secure station with interview rooms, and areas for private conversation, and the minor’s guardian is present. Because this is a sexual assault allegation of a minor, a representative from victim advocacy should also be present. This environment can feel very private and secure and may assist the victim in sharing her story. If there were too many people around or a loud, boisterous environment could make her less likely to feel comfortable. These sorts of cases can be stressful for interviewers as well as interviewees, and the closed, quiet interview space can be a definite help in keeping one’s demeanor neutral when hearing details of upsetting cases, especially involving minors
You are working at the local courthouse as a victim witness advocate and are meeting with a victim of a domestic assault and battery. The purpose of the interview is to prepare the victim for an upcoming criminal trial This is a formal setting, as a courthouse has meeting and interview rooms that are private and often set with tables and chairs. The victim should be offered a victim advocate present, and all interviewees should remain formal and delicate in the proceeding. The victim, much like the previous one, most likely is positively affected by the private and quiet environment as recalling events of trauma can be traumatic in themselves and it can be easier to do with a smaller, more intimate audience. If this were more public, she may not wish to share any personal details that she may feel some sort of blame or shame for. The interviewer will need to be an active listener and just allow the victim to share details before asking questions to fill in the gaps. This environment allows for a quiet, private place to allow there to be no distractions or possible stressors surrounding the environment of the interview.
