The sock, including its contents, is abandoned property. From Pierson v. Post and Popov v. Hayashi, it is clear that possession plays a key role in defining the rights in such property. In this case, each boy had physical control over the sock for a short period of time. But it appears that, prior to it becoming known that the sock contained money, no boy retained control of the sock or even intended to do so. In Popov v. Hayashi, the court reasoned that if more than one party has a valid claim to a single piece of property, the undivided interest in the property of the parties should be recognized in proportion of the strength of their claims. There appears to be no reason for any boy to have a claim superior to the others, so the five boys should have equal interest in the discovered property (i.e., money). Therefore, following the principle of equitable division, the money should be divided equally among the five boys.
