Yvonne Wyatt-Rose Ethics Homework Chapter 5 Part One: Complete the Cooperative Learning Exercise on pages 124-125. Please make sure all answers are in complete sentences and a full paragraph or more. To complete the following exercise, I began by identifying my own ethical concern pertaining to each scenario based on the information provided within this and previous chapters. I discussed each scenario with colleagues for additional feedback, along with the school counselor on my campus and my sister-in-law who is a professional practitioner. Each situation led to some very interesting dialogue and helped me better understand the overall connection between ethics and law Scenerio 1 In the case of the 13-year-old girl asking advise and direction of her school counselor for an abortion, I consider this unethical and illegal. Due to the girls age and because she consulted with the school counselor, and not a private practitioner, as a minor the counselor’s duty of care to the girl, is to provide support but she is required to notify the parents of the pregnancy and should not have given out any information about abortion clinics to the minor without parental consent. The counselor’s actions were unethical and illegal. Should the girl seek out services for the abortion and something happen to her, the parents have right to pursue legal action toward the counselor for the manner in which she handled the situation. Per my school counselor, unless the student is 18, matters to this degree must be reported to the parent or appropriate authorities. Had this been a private profession practice situation, the counselor would be Scenerio 2 In the case of the Vietnam War veteran voluntarily seeking counseling and exposing during therapy his intent to kill some college student is a conflict of ethics and law. The therapist should notify authorities of the veteran’s intent as to the potential harm that could come to the college students should the veteran follow through with the threat. The ethical obligation is to the client, but a threat to this magnitude is not to be taken lightly. There are obvious mental health concerns as a result of the post-traumatic stress disorder and overlooking such information could result in harm to both the client and others. The fiduciary relationship to the client is priority and to be handled with care but when others could be in danger as a result of client actions, true duty of reason is in place when the appropriate authorities are notified to help provide service. Scenerio 3 In the final scenario of the counselor following up with a former patient and asking her out on a date, this is a case of unethical, yet legal. While it is not illegal to ask someone
of consenting age on a date, it is definitely a conflict of interest and unethical to pursue a romantic relationship with a former patient. To use the helping relationship as an avenue for personal gain is unethical. Even after services have been terminated, due to the nature of the helping relationship, minimal duty of care still exists and should be exercise at all times. Contacting a former client as a follow up of service is within reason but to ask a client on a date transitioned the service to unethical and was not good decision making on half of the counselor. Part Two: Ethical, Yet Illegal: Re-read this section on page 117. Answer the following questions in complete sentences. Would you tell the person’s sexual partner about the HIV diagnosis? Yes, I would tell the person’s sexual partner. Why or Why not? What led you to make this decision While disclosing a client’s status without their permission may be illegal, it is important to remember that behavior that could potentially expose or harm another cannot not go unnoticed. The sexual partner is in harm as a result of not knowing about the positive HIV status and has a right to know. I also consider this a reminder of duty of care, while obligation is always to the client, the potential of harm to another in my opinion extends that duty of care to the person in harm as well. What does the law in Texas say about disclosing this information (please be specific and site the law) . In the state of Texas there are no criminal laws in place in respect to sharing positive HIV status with sexual partners What is the importance of understanding the laws in the state(s) you practice in? It is important to understand the laws in the states you practice because this is what will protect you should your because not all practice conduct is considered unethical or illegal in all state. Part Three: Define the Important Terms from the Chapter Bogust v. Iverson – none-therapist college advisers have no duty to prevent student suicide Contractual - of or relating to the things that are required by a contract; duty of care established Duty beyond reason Duty to care – legal obligation not to harm. Eisel v. Board of Education - special relationship for duty of care to protect student from harm in the counselor student relationship Ethical, yet illegal – acting in the greater good of a person but actions may be illegal; such as running a red light to attend a medical emergency. Implicit acts - duty of care established by helper creating a special relationship Legal precedent - a legal case establishing a principle or rule that a court or other judicial body utilizes when deciding subsequent cases with similar issues or facts
Nally v. Grace Community Church - case where parents take church and pastor to court, but no duty of care was breached Prima facie – at first sight Principle of fiduciary responsibility – when the counselor acts in good faith and loyalty toward the client, not abusing their power or exploiting the client but acting in the client’s best interest. Unethical, yet legal – lying to your boss about being sick to miss a day of work or cheating on your spouse. Part Four: Do some sort of self-care activity this week! Enjoy some time for just you and tell me about it. I want to begin by thanking you for including a self-care activity as part of the homework this week. Self-care is so important and I am almost shame to admit I have been needing to take time to refuel and refocus for a while but I have been putting it off. I have been feeling very overwhelmed lately and manifesting stress within my physical body as a result of my blood pressure being high several days this week. However, I am happy to report I took two nights this week and specifically dedicated them to me. I placed my phone on do not disturb, enjoyed a nice, hot bubble bath with scented candles and soft tranquil music. I laughed at myself because I did fall asleep in the tub and was all wrinkly when I got out but it was well worth it. I can’t remember the last time I was able to take a bath and not just a quick shower. I was in bed by 9:00 p.m., read a few pages of a book that was not school related and got a good night’s rest. I also scheduled a mani-pedi appointment for Friday and plan on treating myself to a nice dinner. Thank you again for the simple reminder of self-care. I feel much better because of it.
