Managing Counseling Relationships
For this assignment, review the specialization-specific case provided by your instructor and complete the prompts below. The cases are in the "Your Instructor” area.
The Ethical Dilemma(s) 1.
Describe the ethical dilemma(s) presented in the case.
This a case concerning primary custodial care. Sofia is a 15-year-old whose mother said she is showing signs of depression. Sofia has admitted to feeling sad and crying and has also engaged in self harm merely two days ago due to feeling overwhelmed. Sofia’s parents are getting a divorce and she is feeling some guild attached to her parents’ separation. According to Sofia’s mother her father allegedly a suffers from bipolar disorder and had been getting treatment. He allegedly has a history of being hospitalized due to previous years of non-compliance with his medications. This resulted in psychotic episodes and violence. Sofia’s mother has a history of psychiatric treatment for depression and anxiety and is taking medication. Sofia has a three year old MDD diagnosis. 2.
Identify unavailable facts relative to the ethical dilemma(s).
Some facts that are unavailable would be if the father was ever violent towards Sofia, her brother or her mother. Also, why is Sofia’s fear about her being sent to the “crazy hospital” like her dad, has she been threatened with that before? And if so by who. 2
Concerns about her standing at school as far as grades, and if changing schools are going to fix the issue at hand.
State Laws and Regulations

Describe at least two state legal standards that help guide counselors to establish ethical relationships with clients or students through two specific requirements (e.g., informed consent, managing boundaries, payment for services, etc.).
State legal standard 1: La. Admin. Code tit 46 LX 2103: Counseling Relationship
Counseling relationships provide counselors with a guideline of the responsibility they have when working with clients. It speaks on how as a counselor it is our responsibility to
respect the dignity of the client and promote the welfare of clients. It also speaks on how to maintain records, counseling plans, informed consent and much more. It also covers the rights that the client has and fees of the counselor.
State legal standard 2: La. Admin Code Title 46 LX 2109: Relationship with Other Professionals
When working in counseling it is inevitable that at some point in one’s career that they may have to work with other professionals. This law provides a standard of professional interactions, respect for colleagues and how to work collaborative with the interdisciplinary team. The team of colleagues are all working together to improve the services that the client is getting, so it is important that those interaction between those working together are professional and ethically sound.

Reflect on the impact state laws have on the counseling relationship.
The state laws provide a guideline on how to enter and maintain a conducive relationship between counselor and client. It provides structure so that it eliminates the probability to develop dual relationships when working with clients. These laws also assist in providing
information on how a counselor is expected to interact with other professionals and how it is the counselor’s responsibility to ensure that the client is being handled with respect and dignity.
Diverse Populations

Describe the ethical responsibilities when counseling diverse populations.
It is an ethical responsibility of counselors to be culturally appropriate and how to explain
things in an understandable language in relation to informed consent. Additionally, it is important to ask questions regarding diverse population to avoid unintentionally offending the client and/or the client’s family. This can also affect informed consent procedures if it may go against religious or cultural beliefs, and it is the job of the counselor to adjust the practice accordingly.

Explain how ethical responsibilities affect the counseling relationship in a way that is well supported by the literature.
Ethical responsibilities protect the counselor by defining the limits of the counseling relationship. Clients are their most vulnerable during sessions with their counselors and that can cause those relationship to move beyond the scope of the relationship. Additionally help the counselor to make decisions when more support may be needed by 4
the client. Ethics assist both counselors and client maintain boundaries, all the while curating a healthy relationship that takes both parties interest into consideration.

Describe three specific ethical codes/standards that would guide you in managing the relationship in the ethical dilemma.
Ethical code/standard 1: E.3.a: Proper Diagnosis
Ethical code/standard 2: E.5.b: Cultural Sensitivity
Ethical code/standard 3: D.1.b: Forming Relationships

Explain how these codes/standards could be applied to mitigate the ethical dilemma.
These three ethical codes would be applied to assist in making the custodial schedule for Sofia. Code E.5.a would be utilized to evaluate if Sofia does have MDD since it has been three years since her diagnosis. Additionally, an evaluation of the Sofia’s father and mother would need to be done to ensure that 1. Sofia’s father does have bipolar disorder and if he is still currently taking his medication. Code E.5.b is important as they are of a different culture than myself, I would want to ensure that I am not going against any cultural standards, and I am communicating what it is that I am doing is not going to offend or insult anyone. Code D.1.b will be implemented as I would be working with an interdisciplinary team, and we would have to collaborate on certain elements of treatment
and decision making when it comes to the schedule of custody.

10. Articulate strategies for interfacing ethically with the interdisciplinary team involved in a case.

Since it would a group effort during this case, as the counselor for Sofia I would ensure that I would be respectful of the different approaches as the others that are a part of this case have their own theories, ethics, and scientific foundations that my own. Also, I would ensure that we would remember that we are working for that is best for Sofia and her brother. I would suggest that we go over what is presented and look at the history of the parents and listen and be openminded to the various perspectives of the professionals present. Once we have all given our information that we can legally and ethically share, we should then go over the health and well being of both children since there is an evident history of mental health issues within the family.
11. Explain the impact this interaction might have on the counseling relationship.
This interaction can either make or break the counseling relationship. In my opinion it would strengthen the relationship as Sofia would know that I am operating in the best interest of Sofia and nothing more. Since I would have already gone over my role as a counselor and her role as a client, it would be made prevalent that I am going to act on what is best and ethical for her to ensure she is in the best environment that is not going to cause her more issues mentally.
