To put it quite simply, chat gpt is often called a language machine that uses
statistics, reinforcement learning, and supervised learning to index words, phrases, and
sentences. Engines like chat-gpt are trained to mimic writing styles, avoid certain types of
conversions, and learn from your questions and store the information for future purposes.

The data is skewed since it originates from approved data sets that are used to
train the models. It also contains a large amount of inaccurate information gleaned from
the internet on various topics. Consider diseases as an example. If we employ a chatbot
for assistance, it may provide a person with a variety of confusing information.

The use of ChatGPT was discovered after Avianca’s lawyers couldn’t find some
of the court documents for the cases to which Mata’s team referred, and filed a request
asking for more information on them. Schwartz then went back to ChatGPT to get copies
of the case documents, still believing it was a search engine, and handed them over to
Mata’s other attorney Peter LoDuca, Schwartz’s attorneys explained in court filings.
When reviewing the documents provided, New York-based federal Judge P. Kevin Castel
determined the cases were fake, and announced that the court was facing an
“unprecedented circumstance” and would consider imposing sanctions.

One moral theory that can be applied to address the issue described, where a
lawyer used ChatGPT to fabricate cases in court, is Kantianism, which is based on the
ethical philosophy of Immanuel Kant. Kantianism emphasizes the importance of moral
principles, particularly the principle of universalizability and the concept of treating
individuals as ends in themselves rather than as means to an end.
a. Honesty and Truthfulness:
- Lawyers and other legal professionals should adhere to the principle of honesty. They
should refrain from using AI tools to create fake or misleading information, as it violates
the principle of truthfulness.
- Kantian ethics emphasizes the importance of treating others with respect and dignity.
Fabricating information undermines the trust and respect necessary for a fair legal
system.
b. Universalizability:
- Lawyers using AI tools should ask themselves whether their actions, such as citing
information from ChatGPT, could be consistently applied as a universal rule without
leading to contradictions. If the widespread use of AI for deception in legal proceedings
would be morally objectionable, it should be avoided.
c. Respecting Others as Ends:
- Lawyers must respect the integrity and dignity of the legal system and the individuals
involved. Using AI tools to deceive the court not only disrespects the legal process but
also compromises the rights and interests of others involved in the case.
d. Transparency and Accountability:
- Legal professionals should be transparent about the tools and technologies they use in
their practice. If AI tools like ChatGPT are employed, it should be disclosed to opposing
parties, judges, and the court.
- Emphasizing accountability ensures that lawyers take responsibility for the
information they present in court and discourages unethical practices.
By adopting a Kantian perspective, legal professionals can contribute to a more ethical
and trustworthy legal system, respecting the principles of honesty, universalizability, and
the intrinsic value of individuals involved in legal proceedings. Transparency and
accountability play crucial roles in upholding these principles and fostering a legal
environment based on integrity and fairness.
