No person who enters a restaurant or any other business establishment should not fear being attacked especially in private areas such as that of the bathroom. The offender went into the bathroom and broke the lock to assault the defendant which led to her having serious injuries and
a potential head injury. This is not something that the defendant could have seen coming. The broken door in the bathroom was known to the workers of the business. The situation got even more severe when it was known that the camera system was not working. The camera system is an important part of making sure businesses are secure, but the restaurant failed in this aspect. This also leads to the offender not being easily identified. The owner of the business failed to have the proper security mechanism that would have allowed everyone to stay safe. “Premises security litigation always starts with looking into the ‘Retrospect scope’ and micro analyzing events and decisions that have occurred way before This criminal event happens. The main issue,
in this case, is if the owner of the restaurant is liable for failing to maintain locked doors and security cameras, the owner failed to protect customers from preventable criminal activity criminal conduct” (Grossman, 2019). When a person owns a business, they need to maintain the proper security protocols and equipment such as that of a real security system and proper locking
doors. The owner of the restaurant failed to maintain the safety protocols which left the customer
at risk and left them open for litigation within the criminal justice system.
