Law or Legal Issues Affecting Operational Policies in Supply Chain and Logistics Mercy Ndahr Frontend Team Lead Walmart Bismarck November 12, 2023 Tim Morris Store Manager Walmart Bismarck Subject: Analysis of the Impact of The California Transparency in Supply Chains Act on Operational Policies in Supply Chain and Logistics Dear Mr. Morris Supply chain and logistics laws and regulations comprise legal requirements for anti- corruption, human rights, environmental protection, and sustainability. These guidelines include ESG standards, bribery, anti-corruption principles, data security and privacy regulations, and product quality and safety requirements (California Department of Justice, 2015). ESG standards stipulate the governance, social, and environmental requirements for child labor, workers' compensation, and human rights as essential elements of social responsibility in SCML (Serrao, 2023). Quality regulation and product safety standards ensure that products are tested and labeled as per their health and safety compliance.
Law or Legal Issues Affecting Operational Policies in Supply Chain and Logistics Supply chain laws govern international and national trade agreements, custom procedures, and export/import restrictions across regional borders. As such, these regulations are powerful enough to facilitate or hinder international trade patterns (Serrao, 2023). Thus, supply chain managers must track the evolution of various laws and review existing policies as required to maintain compliance. The focus of this report will be to demonstrate how the California Transparency in Supply Chains Act affects labor policies and procedures for supply chains and logistics enterprises in California. The California Transparency in Supply Chains Act The California Transparency in Supply Chains Act is a legal requirement in a supply chain that enhances labor accountability for supply chain companies operating within California. According to the California Department of Justice (2015), this law aims to protect supply chain employees from human trafficking by providing workers with detailed information about efforts made by manufacturers and retailers to eradicate unethical labor practices. Supply chain businesses must publish their worker protection disclosures on their respective websites. These public disclosures enable potential employees and the public to ascertain that a company's products or goods are not produced by forced, coerced, or enslaved workers. The law also offers companies model disclosure guidelines that supply chain organizations can restructure to fit specific mandates. Despite the law's influence on a supply chain company's labor practice, it does not require organizations to reveal trade, proprietary, and confidential information. The California Transparency in Supply Chains Act applies to businesses operating in California, those identified as retail sellers and manufacturers on tax returns, and those with annual receipts surpassing $100 million. The disclosure must contain primary information, including audits, certification, verification, training, and internal accountability. The California

Law or Legal Issues Affecting Operational Policies in Supply Chain and Logistics Department of Justice (2015) described verification as the extent to which a manufacturer or retail seller participates in product verification aimed at addressing the risks of slavery and trafficking. Moreover, companies are required to make public their disclosure through audits. Supply chain organizations must take crucial steps to demonstrate compliance with this law, including placing a disclosure link on their website's homepage. This link should direct website visitors to the disclosure page without accessing other hidden pages. The disclosure link must be conspicuous to attract website visitors' attention. Most importantly, the verification protocols should be described to the public in detail to allow them to fully comprehend the degree to which respective businesses have addressed and evaluated the risk of slavery and human trafficking (California Department of Justice, 2015). The California Transparency in Supply Chains Act also infringes on supply chain contract designs as a risk management protocol. The law requires companies to directly or indirectly engage with their suppliers to minimize risk exposure. I trust that this report will provide valuable insights into the implications of the California transparency in supply chain act on our operational policies within the supply chain and logistics.
