End of chapter Case Summary Questions for Chapters 5 Case Summary 5.1 Go swami v. American Collections Enterprise, Inc., 377 F.3d 488 (5 th Cir.2004) 1. Is the letter misleading? No. The letter is not misleading since ACEI could have chosen to settle the debt at any amount up to 50%. 2. Is it unethical to tell a partial truth as ACEI did here? There are instances where it is unethical to tell a partial truth for example if the information that someone omits was important for the other party to make an informed decision. ACEI in this case did not tell partial truth, just unless they planned to increase the percentage of discount from 30%.They were not entitled to tell Goswami what they agreed with Capital one. 3. Is failure to disclose a fact same as telling a lie? Sometimes yes. Failure to disclose a fact is the same as telling a lie when the omitted fact is important for a party to make an informed decision. If the person or party with the information is not obliged to tell the information, then it is not a lie.
