2 1.0 INTRODUCTION: Occupational health and safety are the recognition, assessment and control of hazards associated with the work environment. It cannot be denied that there are number of risks that engaged with each job. So, it has become the major goal for and every HR to minimize occupational injuries and illness. There is no doubt that when an employee is accepting a proposal for job, he also accepts every risk that could be associated with it is the duty of a good employer that he/she should make sure that the risk is reduced as much as possible and make sure they work in safe and efficient conditions. 2.0 OBSERVATION: Being the members of the urban property management, we realized that young people have been working at our company to fulfill the living costs by working part time as well as full time some of them were summer students however some were full-time hired. But we have noticed a significant increase in worksite injury accident claims. Apart from this, we have noticed that all of my associates were young and inexperienced with their work as well as rights, hence, it was important for us to make sure that our company’s employees should know about their legal rights and how to protect themselves from the injury costs. THE NOTE: Operation Director 3.0 PUPRPOSE We are writing this email to you regarding the awareness of basic rights of workers and how we can make them understand the importance of it. 4.0 BACKGROUND A study by Canadian OH&S researchers suggested that only 50% of the injured workers reported that injury to the employer or to a doctor. There are several reasons of this, maybe they do not report their injuries because they get afraid to blaming themselves for the injury or also have a fear that may employers think that reporting was too much of a hassle and protecting their self- identity would make them feel safe. There are multiple reasons for such practices: 1} Lack of experience and training due to which they are not able to recognize hazards in the workplace. 2} Many workers are unaware of their rights to a safe working environment and the rights to refuse the unsafe work 3} Last but not the least, most part time or short-term employees feel that we are not offered the same level of safety training as the full-time employees.

3 5.0 CORRECTIVE ACTIONS: Every worker has basic rights which are as: 5.1 Worker’s Rights- In Ontario, workers have three basic rights that give workers this power: the right to know, the right to participate, the right to refuse. The Right to Know ; According to this right the workers have right to know about all the hazards and safety practices at workplace where they are working. According to the guidelines of Occupational Health and Safety Act (OHSA), it is the responsibility of employer to provide all the information related to safety and hazards to the employees and make health safety committees in the organization. The employer will also ensure that the committee should have proper communication with workers. For instance; In Canada every employee and employer know about WHMIS ( Workplace Hazardous Materials Information System). This will help the workers to know about all the hazards and chemicals presence at workplace. This is a one of the examples of right to know. WHMIS has three key points – Worker training and education; Education to worker include information about all the hazardous material at workplace and training include how to use information that present in WHMIS. The Right to Participate- Workers have right to participate in making recommendations about health and safety. In organization there should be JHSC (Joint Health & Safety committee). Worker from JHSC has a right to give suggestions about improvement in health and safety activities at workplace. Employer must consult with JHSC while testing the equipment, adding new substances or any other workplace safety activity. Worker from JHSC have a right to inspect the working site daily for safety precautions, participate in inspecting any serious accidents happened on site. Those workers who are certified have a right to investigate the complaints about serious problems. Whenever workers make any recommendation for improvement, employer should be responsible for response in written within 21 days. The Right to Refuse- The workers have full right to deny or refuse the work if they feel that this will put their health and safety in danger. According to Occupational Health and Safety Act there are specific procedure for this right. There are two process in which the worker can deny to work- Firstly he/she refused to work if they feel that work is dangerous and inform to the present supervisor or employer. Then supervisor will investigate the work and workplace accordingly.
4 Then again if worker not feel safe, he/she has a right to refuse work, then the employer must call a Ministry of Labour Inspector to investigate further. Not all the workers have this right at their workplace. Though some worker, such as firefighters, health care workers, teachers and police officers have restrictions on their right to refuse. 5.2 Why it is Important to know rights? Employees plays a very important role in organization. It is the duty of employer to keep safe their employees or workers. It is extremely important for workers or employees to know the legal and Constitutional rights of workers. These rights are the foundation of legal system and are in place for the protection of every citizen of this country. Failure to know and utilize these rights leads to their erosion and possibly in getting deeper into trouble. Employees have full liberty and equality at workplace to know and utilize these rights. 5.3 How we can aware employees- As an employer there are many strategies through which we can aware workers about their rights and benefits. Develop an Employee Rights Handbook - In this handbook write all rights of workers and policies of organization. This will prevent any kind of misunderstanding about rights, benefits and policies within company. When employee start working with company should be provided with this handbook and acknowledgement must be signed by workers that ensure that they accept this handbook. Design and display Posters - Design posters about workers’ rights, with explanation that which right include which information. Display these posters on every working site, major office locations, must be visible to all workers. Orientation and Regular Meetings - Conduct orientation before workers start their work about all laws, rights and policies of company. Also conduct regular meetings if there are any changes in laws, so that employees will remain up to date. Make attendance sheet where employee can put their attendance as a proof that they attend that orientation and
5 meetings so that in future it will not the fault of employer if employee will not know any right. Part time and temporary employees should also be part of orientation ad meetings.
