Questions of Libel:
1.
Have there been any fictitious declarations prepared by any individual in
regard to the companies critical and destructive information that was placed
on any social media platform?
2.
The declarations which were prepared by the individual, did they appear to
be detrimental or destructive to the company’s character or does it seem as if
it would harm the way the public views it?
3.
Due to the public figures negative content and/or reviews, has the company
inquired any losses?
4.
The negative information that has been observed, has it been posted by the
public figure and made visible to a large audience?
Elements of Libel:
Question One: In order for the statement to meet the elements of Libel, the
statement which was made cannot be true nor founded on any truth. If the
individual has in fact made an untrue statement surrounded by any company
in their critical information, then this element of libel has been encountered.
Question Two: In order for elements of libel to apply, the offensive
statement, should cause damage to the character of the company.
If such
statements made indeed are offensive or detrimental to the company’s public
image, then the element of libel has been encountered.
Reputation:
When it comes to safeguarding and putting reputations of public individuals,
companies, and simple citizens that have had false information released in any
form, back together, Libel Law has a essential part in doing so. "In libel cases,
plaintiffs who are public figures or officials have to meet a more stringent standard
(actual malice) than do private citizens (negligence) if they are to collect damages
(Bugh, n.d.)." Directing libel cases essentially challenges skill in defamation law.
One article based on libel states, "Libel is a category of defamation that includes
defamatory statements that are published or broadcast. Libel is a tort under
common law for which a defamed party can sue for damages (Hayes, 2023)."
Providing legal alternatives allows people to seek legal assistance and have justice
brought against those individuals responsible for deformation of character. The law
does
push accountable journalism and other communications, it simply provides
incentives to have all information verified, ensuring that it is the truth, prior to
publishing it. This acts as a restraint, giving a warning to those that my give false
information, of the legal consequences they may encounter by doing so.
Possibility of a Case:
According to the information that has been provided as well as the questions that
have been provided, It seems as if the scenario could be more libel that
opinionated. I believe that the individual (public figure) has placed damaging and
untrue information regarding the company on various social media platforms.
By
the statements being untrue, and possibly damaging to the company’s reputation
they fall under the category for libel.
Furthermore, because the comments that are
negative and untrue are visible to a broad group of individuals, to include the
company’s social media followers and the public in general, the harm that could
possibly be caused to the company’s reputation could be very much essential. Due
to a well-known public individual being involved increases the value of the
situation, as that individual’s impact and/or following could increase the negative
content and its impact.
All of these reasons causes support to the case for libel.
