Courts
What They Do
Their job is to maintain public safety by apprehending criminals.
They also implement trust and safety within the community. The courts apply the lse to the cases under their jurisdiction. Courts interpret
federal and state laws and separate them
under whichever jurisdiction is allowed.
Jurisdictional
Issues
Sanctuary Cities prevent law enforcement to enforce federal laws because it protects undocumented immigrants. Immigration statutes are a federal jurisdiction issue. Smaller courts have trials and their own
rules and policies regarding illegal immigrants. Sanctuary cities force the courts to release the illegal immigrants without contacting ICE. Describe how the U.S. law enforcement and court systems function together.
Law enforcement apprehend criminals and prevent further criminal activity by policing the local areas and communities. Law enforcement works with the courts to bring justice to those
arrested and determine their innocence or guilt. They then apply punishment as needed through fines, probation, or incarceration. Include at least one dysfunction or challenge area.
Sanctuary cities protect undocumented immigrants from deportation or prosecution despite federal immigration laws. With that law enforcement can not arrest without proper evidence or a warrant. If the law enforcement can not obtain that the court can’t properly uphold the charges and they will be released. Follow-Up Questions
Answer the questions below in two to five sentences in order to elaborate on the process represented in the graphic organizer above. Use examples from the article provided in the Module Four Assignment Guidelines and Rubric to support your responses.
Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? The Senate Bill 4 prohibited racial profiling and discrimination. It allows law enforcement to ask about the immigration status of the individual they have encountered. This decision is optional and not mandatory of the officer so it leads to little action on police operation to the Senate Bill 4.
Identify the functions of court systems related to sanctuary cities in the resources provided.
What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? The US Court of Appeals for the Fifth Circuit allows the courts within the justification and its ruling to be appealed by the Supreme Court and the US. They are supposed to uphold federal law, with sanctuary cities the courts are required to uphold the constitution law. However
because the Senate Bill 4 allows the officer to use their discretion in asking about their legal statutes the local policies can affect the cases. Under federal law the immigrant charged can be deported. Even so those who are not identified as illegal, the Fifth Circuit can afford them protection. Describe how the U.S. law enforcement and court systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area for the police in relationship to holding detainees? In sanctuary cities law enforcements and the courts are stuck in the middle of trying to keep the peace with the immigrants and holding the detainees. The police have to comply with the Senate Bill 4 by holding the detainees. The immigrants are outraged by this because they are supposed to be protecting the sanctuary cities.
