2 In the case of Mr. C and his lying about having the proper coaching credentials, there are several implications of things that could happen because of this. Based on the Iowa Administration Code for educational requirements a coach must have certain credentials as far as classes taken, as well as education on concussion protocols. Without the proper authorization, anything that could go wrong during a practice or game event could result in an unintentional tort of Negligence being brought against Mr. C. It is possible Mr. C could also be held liable for some type of breach of contract for claiming to have authorization which he did not possess. According to the BOEE Code of Professional Conduct and Ethics Mr. C could be guilty of violating “Standard III- misrepresentation, falsification of information ”. The worst case scenario for Mr. C would be that a student suffered a serious injury under his supervision. An injury incurred by a student while under the care of an unauthorized coach could open Mr. C, the school, and the school district to lawsuits against them. Regarding the school that hired Mr. C they could also possibly be guilty of an unintentional tort of Negligence. It is also possible that school the failing to verify Mr. C’s coaching authorization would fall under breach of duty. As a school athletic program one of their most important duties is to properly check and verify each coach has the correct training and certification. Any impropriety conducted by Mr. C could be blamed on the school and the school district for allowing an unauthorized coach into a position of authority without the proper credentials. Also, if the public were to hear about how the school failed to do their duty in checking credentials it could hurt their reputation and recruiting for their sports teams could decline as well. A proper response to this scenario would be for Mr. C to excuse himself on a temporary basis until his proper credentials are in order. He should come clean to the principal and athletic
3 director and hope that he is given the opportunity to fix things and continue with his job once everything has been properly documented. Some proactive measures to prevent such things from occurring in the future would be for the school’s administration department and athletic department director to have a set in stone checklist that must be cleared and checked off for a coach to take his position. In the case of a teacher being reassigned outside of their endorsement area both the teacher and the principal are at fault in this situation. The principal and the administrative department should screen the teacher’s credentials before moving them to a new position. If the principal desires the teacher to transfer, they should give the teacher fair warning and time to acquire the correct credentials before making the transfer. In the world of academia where teachers and faculty are put into positions of trust, it is imperative that all parties involved follow all applicable rules and regulations when it comes to licensing and checking teacher’s credentials.
