An important benefit and compliance issue that I have seen in my personal work experience is when to clock in and what is considered hours worked for an organization. In a lot of restaurants I have worked at, they have told us not to clock in until we receive a table. However, according to the Portal to Portal Act of 1947 (UMGC, n.d.), hours worked is defined to also include compensable activities such as non-production time cleanup, travel between job locations within scope of regular work shift, and rest periods shorter than 20 minutes. This would include the time I would be scheduled to come in, am ready and waiting in uniform for a table. Sometimes you have to wait an hour for a table on a slow day. Another compliance issue I have seen personally while working is the time and a half pay required by the FLSA for overtime work (UMGC, n.d.). I used to serve tables working atleast 50 hours a
week, but never received a check for my $3 hourly pay or overtime. I was told that it was because taxes pulled all the money away, however at tax time I also owed another several thousand. This made me think there was a compliance issue with the organization where they were not accurately putting in hours or paying us overtime for hours worked. At other restaurants I have worked at, I always received a small check for my $3/hourly. I think that in the restaurant industry they are often trying to cut costs and that can lead some organizations to also cut corners regarding paying staff. However, if any employee decided to take the company to court it could become a large troublesome lawsuit for them where they would have to compensate whoever they did this to.
