Discussion #2 Select one benefit and compliance issue identified in Module 3 and share why you feel it is a potentially risky one of which all organizations need to be aware. Use a minimum of one reference from the class materials. No need to respond to other students. While benefits and compliance issues may vary depending on the specific industry, size, and nature of a company, there are certain benefits and compliance issues that are generally applicable to all companies in the United States. Health insurance and equal employment opportunities are one benefit and one compliance issue that all companies should be aware of within the United States. Providing access to health insurance is a fundamental benefit that should be considered by all companies. The Affordable Care Act of 2010 (ACA) requires that large employers (those with 50 or more full-time employees) offer affordable health insurance coverage to their employees or face penalties. Health insurance is a critical component of an employee's overall compensation package and can have a significant impact on their well-being and job satisfaction but is also one of the most significant costs of employees to a company (University of Minnesota, 2016, Voluntary: Medical Insurance). Moreover, it is often a key factor in attracting and retaining talent, as only about 62% of companies offer the ability (University of Minnesota, 2016, Voluntary: Medical Insurance). All companies in the United States must comply with federal and state equal employment opportunity laws. This includes Title VII of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, religion, sex, and national origin, as well as other laws that protect against discrimination based on age (Age Discrimination in Employment Act), disability (Americans with Disabilities Act), and other factors. While normally associated with hiring, this
includes benefits that the company offers (UMGC, Module 3 Commentary, Topic 3). Compliance with these laws is essential to ensuring fair and equitable treatment of employees and avoiding legal issues related to discrimination or harassment. It's important to note that while these are fundamental benefits and compliance issues that apply broadly, companies should also consider industry-specific regulations and the unique needs and preferences of their workforce when designing their total rewards packages and compliance strategies.
