Summary: The Fourth Amendment to the United States Constitution protects citizens from unreasonable searches and seizures by law enforcement. It states that individuals have the right to be secure in their persons, houses, papers, and effects, and that warrants for searches or seizures must be based on probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized. This constitutional provision aims to safeguard individual privacy and prevent arbitrary intrusions by authorities, ensuring that searches and seizures are conducted with proper legal authorization and justification, balancing the need for law enforcement with the protection of citizens' rights. Professionals: Identify three to five examples of how the specific rights given to citizens in your chosen amendment might potentially restrict the actions of professionals in the criminal justice system. Professionals: 1. A police officer who searched a suspects home without a warrant may find evidence pertinent to an investigation. However, as the search was done without a legal warrant, the evidence is considered void, and is no longer applicable in court. An example of this can be found in the Mapp vs. Ohio case of 1961 (Crash, 2016). This poses a issue for police officers who may have suspicions regarding a suspect, however they are still required to follow the legal procedures of the 4th Amendment. 2. If a police officer is unable to find enough evidence for a search warrant to be issued, the case may need to be shelved until something else comes out. 3. A judge cannot issue a warrant if there is no probable cause. If a judge lacks viable facts as to the presence of evidence in the suspect’s property, they are unable to issue a warrant, and thus searches driven more by instinct or suspicion may not be possible.
