Canada evolved over time and was not in its final form in 1870. When
the Manitoba Act was negotiated, Manitoba was kept purposely small
in 1870 to limit the amount of land the Metis were entitled to, an issue
that Louis Riel complained about in his speech to the court. The 1870

Morris has also left a problematic legacy. His book is one of the few
key resources for understanding how the negotiations occurred for
many of the early Numbered treaties. However, Morris
misrepresented the negotiation process in this book because it does
not reflect the oral promises he gave to Indigenous signatories. The
key issue he skirts in this book is the “land sharing” agreements that
he agreed to in oral negotiations, an agreement that was
subsequently misrepresented in the written documents as “land
surrenders.”
Using Morris' documents of the events, early treaty histories tended
to represent Indigenous dissatisfaction with the treaties as a problem
of "cultural difference" ("they did not understand what they were
agreeing to. . . etc) but, in fact, Morris misled Indigenous negotiators
and gave them misleading information. To this day, Indigenous treaty
holders are upset that the terms they agreed to are not reflected in
the written documents and want the Canadian government to honor
the original promises they made.
When Indigenous peoples say, this is “not in the spirit of the treaty”
they are referring to the original oral promises made to their
communities by the government, which they agreed to in good faith
as part of their promise to share their lands.
