M1A2 Assignment on Historical Memory & Historical Reality The Assignment for Module 1 includes two short-answer question. Each answer will be worth 5 points and should be about 2 paragraphs in length. Base your answers on the information presented in the Historical Reality & Historical Memory Sway lesson. Do not use outside sources. Be sure to use specific examples included in our lesson (including the assigned readings and videos). Answer the questions in your own words. How did the Supreme Court cases of 1883 (Civil Rights Cases) and 1896 (Plessy v. Ferguson) allow for the rise of the Jim Crow South with its legal racial discrimination and segregation? Discuss John Marshall Harlan’s reasoning in his dissents for each case. (In other words, why did Harlan disagree with the majority? Why did he see both majority decisions as constitutionally wrong?) - John Marshall had a diverse opinion compared to most at the time. He believed that a lot of the decisions even if they weren’t alike, undermined equal protection, influenced discrimination and violated the human rights of African Americans. The Supreme Court cases of 1883, known as the Civil Rights Cases or Plessy v. Ferguson had a huge impact in the Jim Crow South and the rise of discrimination. These cases proved to undermine the born given rights of African Americans. In both cases John Marshall stayed loyal to his belief which protested the many others. In the civil rights cases, the court tried to deem that the discrimination in public accommodations was unconstitutional. Marshall further disagreed stating that he believed that congress had the authority to pass legislation under the Thirteenth and Fourteenth Amendments to protect civil rights. In Plessy v. Ferguson, the court ratified racial segregation under the “separate but equal” doctrine. John Marshall’s dissent paid off and he further argued that the majority’s decision violated the fourteenth amendment’s guarantee of equal protection to all citizens of America. John Marshall’s ideology was clear and dissented from the rest. However, our country wouldn’t be where it was today without him and this ideology.

Based on their discussion, explain what the Lost Cause myth was and why the South felt the need to create it. How do we know that it was a myth? -The Lost Cause myth occurred during the civil war and because of it. They sacrificed so much, lost loved ones, prayed, were mistreated and continued to fight so hard and still didn’t get everything they were praying and fighting for. The south felt the need to create “The Lost Cause myth” to help cope with this and the loss and the pain they were feeling after the loss of people’s loved ones after the war. It was a way to come to terms and settle peacefully, coming up with a way to win, even if they didn’t win, because it was just a “myth”. Southerners defended and argued for the lost cause stating that the war was about states’ rights and not about slavery like they were making it out to be. As Dr. Revels explained in the video it was a good way for the southerners to focus on the states’ rights. They were promised these rights and chose to focus on this and instead honor the soldiers lost than to remember the cause behind the centrality of the war which was slavery. We know confidently that “The Lost Cause myth” was a myth because the southerners said these things themselves and there are documents to prove it. These documents are still around as of today. The day before the war, the southerners explicitly said that their reason for leaving the U.S. was the protection of slavery within the constitution. Requirements:
