One of the earliest cases on the right to privacy was determined in 1967. In this case, Justice Harlan's concurrent decision established the "two-part test" for privacy, which is still used today.
Facts of the case:
In contravention of federal law, the petitioner made wagering calls from a phone booth across state boundaries. While monitoring the petitioner for possible illicit gambling activities, FBI agents installed a listening device on top of the phone booth and captured the petitioner's end of his calls. He was detained and found guilty as a result of these recordings. Katz claimed that the state had violated his fourth amendment right to privacy. Additionally, he proposed that the evidence be ruled inadmissible.
