Fruitful Thoughts Good evening, my name is Victoria Franks. I am a Texas native currently residing in Sugarland, Texas. The bill that I will be addressing was first introduced May 11, 2021 by the Texas Legislature. Senate Bill 8 is a companion bill to House Bill 1515 and also known as the Texas Heartbeat Act. Before I address why this bill is unconstitutional towards women and basic human rights, let’s discuss what exactly Senate Bill 8 is. Senate Bill 8 bans abortions after the detection of an embryonic or fetal cardiac activity. Exemptions are only allowed if it is determined to be life detrimental to the individual carrying the unborn child. This bill will allow anyone to sue the abortion providers or those who “aid and abet” the individual with receiving abortion care in Texas after cardiac activity is detected. This law majority affect those who are living on a low income or in rural areas where access to abortion care is limited. A radical decision of an anti-choice bill overturned a nearly fifty year precedent and ended the legal right to abort. This creates dangerous doors to be opened. Unconstitutional opinions of others affecting the world, illegal, not sanitized and unsafe abortion procedures will increase and women or female children’s lives will be at risk. Every eight minutes a woman in a developing nation will die of complications arising from an unsafe abortion which contain additional risks of maternal morbidity and mortality. Five millions women are hospitalized each year for treatment of abortion related complications which can lead 220,000 children motherless. Women who survive an unsafe abortion could/will suffer long-term health complications. Local physician states most laws do not include exceptions for rape and incest. And exceptions for the life of the mother are vague which left them wondering if they must choose between breaking the law or breaking their oath.” For a physician to question ethical oath of duty or risk being criminalized or sued in the process of either saving a mother’s life through an abortion can cause so much
ruckus and confusion. As a social worker, I took an ethical oath too. Social worker oath is dedicating our lives to service of humanity and social justice. Practice the profession responsibly with conscience, integrity, and dignity which are consistent with social work values, ethical principles, and ethical standards and strive to end discrimination, oppression, poverty, and other forms of social injustices, while maintaining the utmost respect for the inherent dignity and worth of every human being. However, what is the ethical approach the government vowed? Let us recall the fourteenth amendment which states: “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor deny to any person within its jurisdiction the equal protection of the laws. (U.S. Const. amend 14)” As I leave you with the fourteenth amendment to think about, does this bill coexist with the 14 th amendment that has existed since July 9, 1868 or does this bill cause great controversy and contrast with “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.” Thank you for your time and consideration of my oppositional opinion of the Senate Bill 8. As seconds, minutes, days or years passes along I hope we as the government and the America people can devise something on which we can both agree and progress in a more effective, commutative and compromising way in the future.
