What would you do if you were providing a psychological test to a counseling client and an issue arose in which your ethics conflicted with the established state and federal laws and codes of ethics? Provide an example to support your response. If I were to provide a psychological test to a client and an issue arose in which my personal ethics were in conflict with the state laws, federal laws, or code of ethics, there would be a few things I would do. To start, I would review the laws that my personal ethics were in conflict with to understand why that conflict is occurring. For example, if my client’s test results showed that they were on the verge of being unable to make decisions for themselves competently and I believed that their family should be informed of this but the client did not believe that, I would first review the HIPAA law associated with confidentiality in order to understand this conflict better. From there, I would review the ACA Code of Ethics (2014) in order to understand which ethical codes I would be breaking. Using the same example as before, the ethical code I would be breaking would be that section B.1.c. for respecting a clients confidentiality. This code states that counselors need to protect a clients confidential information and cannot disclose information without the appropriate consent (American Counseling Association, 2014). Due to the fact that I would not have my client’s consent to disclose the information to their family, ethically I would be unable to do so. After reviewing all the laws and ethical codes associated with my personal ethic conflict, I would reach out to a supervisor to discuss the issue. If after discussing the issue with my supervisor, I still feel conflicted, I would then refer the client to a new counselor who would be better at treating them. American Counseling Association.
