1.) CHAOS! We all know what that word means; but until we experience, we undervalue the System of order maintenance that we have in our society. Its purpose is to create stability, balance, and a safe environment. Each negative act has a reciprocating consequence of equal effect, well we strive for equal effect at least. To protect the individuals' civil rights, a system must be present to oversee that people are not being abused by both their community and court system. Criminal law being present benefits us all; without it comes that saying we all know of, but do not want to experience; CHAOS! Personally, I am pro Law individual; although I feel strongly that many of the laws in the United States are contradicting on various levels; too harsh in one place but not the next; and too old being held by mandatory sentencing created decades ago. I will explain each reason I mention from my perspective and experience. One example of contradiction in the laws is when you look at State Law and Federal Laws. A prime example would be Senate Bill 271 that went into effect in March. This law states That a convicted felon can legally carry a firearm in Colorado if his crime was not one of the victims act right. The bill covers more areas, but specifically this section is special. Being a convicted felon myself since
2006, I have never been able to carry a firearm. So, when I caught wind of this, I contacted the governor's office, CBI, district attorney, sheriff's department, CSPD, and a friend and lawyer Jeremy Lowe. The law reads yes, I can carry a firearm. But federally its illegal, so I cannot purchase one or conceal carry one. This also means, federally I can be charged. CSPD said “well that is what It reads, but do not quote me. I would suggest you carry the bill with you at all times”, sheriffs said, “well I don’t know, depends on the officer and his knowledge of it, hope that helps.” The Attorney general's office said we cannot give any legal advice to you. The CBI said they could only discuss things in relation to concealing carry permits. The governor's office never responded. SO, Jeremy Lowe told me, “I would not recommend u carry a firearm yet. Too new of law, let the kinks be worked out, and do not be the lab rat.” So, the state level says it is ok; but if the officer does not know the law and arrests me anyways, and the DA decides to push the case to the feds, well I am going to prison. I find that to be an issue; and I have yet to get a definite answer. For some being too harsh in places, that I can simply show by stating someone in Kansas in jail for a pound of marijuana, where here, someone can transport it, possess it, or sell it with a caregiver or state license. There are too many big gaps between the laws from state to state in some cases and that is an issue.
My last issue is the minimum mandatory sentencing. It is declining these days and you see changes. Its sentencing guidelines from the Raegan era that hold people to specific sentence regardless of any circumstances of the case or of their character. For example, in NC possession of 28 grams of narcotic (cocaine) is a minimum sentence of 36 months (about 3 years). Someone in possession of 199 grams of the narcotic cocaine, same sentence minimum. These guidelines are now being changed but I find it to be too structural; there must be room for “interpretation of the crime, the person, the sentencing and their danger to the society”, or else we always see this division of respect, power, and understanding from society and/or from the courts. 2.) Do not Silence me! Sounds controlling, doesn’t it? On the other side, You Shall not speak! Sounds authoritative more so than controlling. Well, The American Civil Liberties Union, was a huge advocate to Freedom of Speech since the 1920s. They protested, fought, and ensured that we were protected from being silenced. I agree with the article; I am for freedom of speech; But I am not a fan of ignorance or purposefully worded things to create bi-partisan splits. That does nothing but hurt our bond as a nation. We saw thru the pandemic, the trump elections, the Hillary files, etc. I have personally seen the opposite style as well. I live in China for a year, my best friend worked at the newspaper editing the news and filtering it before releasing it to the mainstream world. Now China, run their show with an iron fist. Ask anyone in America who has no experience there, their thoughts on communism and controlled speech of China. They will be 100% against it. Why though? It works for them; It worked for Castro too. But China these days are more capitalism than communism; the control of speech has benefits as well as cons. The US has benefits and cons. I think there should be a nice median where things are allowed, and other things are not. But the punishment should not be harsh; China is HARSH. I would personally support The American civil liberties union. They were a voice for the silent, a Fist for the weak, and Google for the less intelligent. There should always be someone fighting for the rights of our people, we should be the
ones fighting for our own rights, but some people do not have the resources or the ability. So, I applaud them for speaking out, demanding equality, and opposing the big suits per say. 3.) My favorite discussion! What would that be? Should there be unison amongst all levels of authority, in all jurisdictions, regarding what is wrong, right, acceptable, unacceptable, procedural, or proper standards? I am for it, but we all know that it is impossible; which I will touch on later. I support making things as close as possible regarding fairness. I know this is a tough feat to accomplish. But it is possible, it occurs in other places, we just must sit down without a fight with each other. First, I want to touch on the fact that we as a nation cannot agree completely on anything political, religious, or racial. So the law would be no different. Not because we are opposing, but because we cannot use our common sense for a greater good if it hurts our ego or pride. That is my opinion yes, but its mainstreams thoughts I would bet. Well, the advantages are simple, there would be no grievance amongst procedure, treatment, or consequences. Everyone on the same page, no one can complain of unfairness. Another one would be more funding would be available. We spend so much money on departments specifically for things like ethical issues, moral concerns, and/or violations of rights. If everyone were on the same page, this would not be needed as much. On the other side of the fence, every situation is different, and some situations require judgement calls on the spot. If the line was thin and you are required to walk it no matter what, the small pebble will trip you. What I mean by that is, if you do not allow room for interpretation, or judgment to be applied to a situation, it could be the difference between life or death, capturing a suspect or suspect fleeing, and
even detrimental to the solving of a case. Everyone is not going to be able to be robots, and think like robots, and just be the same. That is the beauty of life. You cannot stop differences in action and thought from occurring, so you must adapt, evolve, adjust, and discuss your ways. That is what our system does. It adapts to its area, in a way that benefits society as a whole. It will never be perfect, but damn sure could be fairer. With all due respect!
